The arts commission shall consist of seven members and an ex officio member of the city staff who shall have no vote. The chairperson, vice-chairperson and secretary of the commission shall be selected by the commission members.

The arts commission members shall serve two-year terms expiring on May 31 of each year. Commissioners may be removed without cause by a vote of the council.

Members of the arts commission shall be appointed by the city council. Members may be reappointed upon expiration of their terms. Vacancies shall be filled for the unexpired terms thereof.

(a) 
Five commissioners shall be residents of the city at the time of appointment and for the term of his office. Any such commissioner who moves from the city during his term of office shall notify the council of the move and shall forfeit his office.
(b) 
Two commissioners may be appointed from outside the city. The city council may elect to fill these two positions with residents from the city. Any resident of the city appointed under this subsection shall be subject to the notification and forfeiture requirements set out in subsection (a) of this section.
(c) 
If a decision or action of the commission will benefit a commissioner in a manner distinguishable from the public at large, such commissioner shall reveal this fact in writing to the city manager and city secretary and shall recuse himself from all discussions and votes before the commission regarding such matter.
(d) 
Commissioners shall be bound by all ordinances of the city and the laws of the state regarding ethical behavior. Commissioners shall at all times comply with the requirements of the state open meetings statutes.

The commission shall meet upon call of the chairperson or the city council. Three (3) council members must agree to call a meeting of the commission and shall submit a written instruction to the city secretary to call a meeting. A quorum shall consist of four (4) members.

Failure to attend three consecutively called meetings shall result in forfeiture of office. A commissioner who cannot attend a meeting shall notify the city secretary of the reason. The commission shall decide as a body whether to excuse the absence.

The duties of the commission are as follows:
(1) 
Encourage participation by citizens in the process of acquiring and commissioning works of art;
(2) 
Foster quality design and the creation of an array of artwork in all media, materials, styles and disciplines that best respond to the distinctive characteristics of each project site and the community that it serves;
(3) 
Seek to ensure that projects reflect the diversity of culture, heritage and expressions of the city and the state;
(4) 
Encourage the selection of artists at the beginning stages of each project who can work successfully as members of the project design team and encourage collaboration among all arts and building disciplines;
(5) 
Encourage art projects for open spaces, parks, infrastructure and facilities that enhance the quality, pride and civic identity of neighborhoods in the city;
(6) 
Encourage the role of artwork in enhancing economic development and cultural tourism;
(7) 
Encourage the role of artists in the functional design of eligible capital improvement projects;
(8) 
Foster and encourage the development of future public artists;
(9) 
Document, preserve, restore and/or repair all public artwork acquired through this process or formally adopted by the commission;
(10) 
Identify potential funding sources including, but not limited to, public and private grants;
(11) 
Prepare and present a budget for any project to be recommended to the council.
