Hereafter no person, firm, corporation, or contractor may excavate in the streets of Pottsboro without first obtaining a written permit to do so signed by the mayor or his duly authorized agent.
(1) 
A request for permission to excavate shall be filled out and signed by the person in charge of the proposed construction. Said request shall contain the following:
(A) 
Name of street.
(B) 
Location of project.
(C) 
Depth of cut:
(i) 
Maximum
(ii) 
Minimum
(D) 
Type of street to be cut.
(E) 
Purpose of project.
(F) 
Agreement of backfill and repair in accordance with this article.
(G) 
Signature of person in charge of construction.
(2) 
The city shall furnish forms for requests and permits, both of which shall be numbered.
(3) 
No permit will be issued for excavation of improved type streets with curbing, guttering and paving except as outlined in Section 3.1002 below.

(a) 
As defined below, the various types of streets require the corresponding repair method.
(1) 
Paved Streets With Curb and Gutter:
(A) 
Top of pipe laid cannot be less than twenty-four inches (24") from top of ditch except that topping material may extend four inches (4") above this.
(B) 
Ditch shall be backfilled with sand (creek or blow sand) to within eighteen inches (18") of the top of the ditch.
(C) 
Good grade of creek gravel or crushed stone, acceptable to city shall be filled to within eight inches (8") of top of ditch and compacted with air compressor or hand tamps if acceptable to the city.
(D) 
On top of compacted gravel shall be six inches (6") of concrete topped with two inches (2") of rock asphalt compacted.
(b) 
Paved Streets Without Curb and Gutter:
(1) 
Same as subsection (a)(1)(A) above,
(2) 
Same as subsection (a)(1)(B) above,
(3) 
Good grade of creek gravel or crushed stone, acceptable to the city, filled level with top of ditch and compacted with air compressor or hand tamp if acceptable to the city.

In the event the person, firm, corporation or contractor should desire that the city furnish the repairs on paved streets, it should so state on the construction request. This in no way, however, relieves the person, firm, corporation or contractor of the responsibility for properly back filling and compacting the ditch.
(1) 
In the event of repair by city forces as in this section or in the event that a street cut is made by city forces to furnish utilities to a property, the following will apply:
(A) 
The minimum charge for any street cut is thirty-five dollars ($35.00).
(B) 
0' - 3' depth:
(i) 
Dirt/Unimproved Streets : $1.25 per foot,
(ii) 
Seal Coat Street: $3.00 per foot,
(iii) 
Asphalt Street: $7.00 per foot,
(iv) 
Concrete Streets: $20.00 per foot.
(C) 
Over 3' depth:
(i) 
Dirt/Unimproved Streets: $2.50 per foot,
(ii) 
Seal Coat Streets: $6.00 per foot,
(iii) 
Asphalt Streets: $l0.00 per foot,
(iv) 
Concrete Streets: $25.00 per foot.
(D) 
Concrete streets will only be cut when there is no choice.
(E) 
All rates will be adjusted higher for unusual circumstances, such as rock, etc.

Excavation not on riding surface of streets and alleys shall be back filled with sand to within eight inches (8") of top of ditch and the remainder may be filled with native dirt or excavated material to the level of the surrounding area.

All excess material excavated and not permitted to be used for back filling must be removed from the job site. Removal must be completed and job site cleaned to the approval of the city within three (3) working days after completion of the project. This section applies to all construction covered by this article.

A special permit may be issued for excavation of a paved street with curb and gutter after it is determined by the city that excavation is the only method available to the person, firm, corporation or contractor to complete a necessary construction project. However, in the event of an emergency when deemed to endanger the health or welfare of the public or destruction of property, any person, firm, corporation or contractor may cut said curbed, guttered and paved street, provided the person ordering the excavation shall immediately thereafter notify the city.
