(a) 
A certain document, one (1) copy of which is on file in the office of the city secretary, being marked and designated as the International Fire Code, 2009 edition, as published by the International Code Council, be and is hereby adopted as the fire code of the city, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said fire code on file in the office of the city are hereby referred to, adopted, and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in subsection (b) of this section.
(b) 
The following sections are hereby revised: Section 101.1 Insert: City of Pottsboro.
(c) 
The geographic limits referred to in certain sections of the 2009 International Fire Code are hereby established as follows:

The code hereby adopted shall be enforced by the chief of the fire department or the fire chief if such officers are different individuals.

Whenever the word "applicable governing body" is used in the code hereby adopted, it shall be held to mean the City of Pottsboro.

Whenever the International Fire Prevention Code conflicts with any other provision of this Code of Ordinances or any other city ordinance, state or federal, such code provision, ordinance or state or federal law shall be controlling.

The chief of the fire department or fire chief shall have power to modify any of the provisions of the International Fire Prevention Code hereby adopted upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code, provided that the spirit of the code shall be observed, public safety secured, and substantial justice done. The particulars of such modification when granted or allowed and the decision of the chief of the fire department thereon shall be entered upon the records of the department and a signed copy shall be furnished the applicant.

Whenever the chief of the fire department or fire chief shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the code do not apply or that the true intent and meaning of the code have been misconstrued or strongly interpreted, the applicant may appeal from the decision of the chief of the fire department or fire chief to the city council within ten (10) days from the date the permit is refused or a decision is made regarding the applicability of the provisions of such code.

Any person who shall violate any of the provisions of the code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate of permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the city council, or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance respectively, be guilty of a class C misdemeanor punishable by a fine in accordance with the general penalty provision in Section 1.109 of this code.
