Unless otherwise provided, the words and phrases used in this article shall have the same meanings as ascribed to them by the Texas Liquor Control Act.

The drinking of any alcoholic beverage on any public street, sidewalk, alley, public parking lot, or private parking lot, within the corporate limits of the City of Pottsboro, Texas, whether afoot or as a passenger in or operator of any vehicle, is unlawful and is prohibited. The finding of within any vehicle or the throwing from or out of any vehicle any open container of the type generally used for alcoholic beverages shall be prima facie evidence that the occupant thereof was then and there drinking alcoholic beverages in violation of this article.

It shall be unlawful for any person to drink or have in his possession any alcoholic beverages within any cemetery located within the corporate limits of the City of Pottsboro, Texas.

It shall be unlawful for any person to drink alcoholic beverages of any kind in any public park within the corporate limits of the City of Pottsboro, Texas.

It shall be unlawful for any person to bring or carry into any enclosure, field or stadium, where athletic events sponsored or participated in by any public school are being held, any alcoholic beverage, or to have any alcoholic beverage in his possession while in or on such enclosure, field or stadium.

It shall be unlawful for any person to get drunk or be found in a state of intoxication in any public place, or on any private property or house, except his own.

Any room, building, structure or place of any kind where alcoholic beverages are stored, possessed, or consumed in violation of this article or the Texas Liquor Control Act, or under conditions and circumstances contrary to the purposes of this article, or the Liquor Control Act, is hereby declared to be a common nuisance, and any person who maintains or assists in maintaining or permits the violation of this article, or the Liquor Control Act shall be guilty of a violation of this article. Additionally, action may be maintained by the City of Pottsboro, Texas to abate and enjoin such nuisance.

Each violation of the provisions of this article shall constitute a separate offense. Each day such violation shall continue shall be a separate offense.

Any minor violating a provision of this article shall be dealt with in accordance with the juvenile law and procedure and if younger than seventeen (17) years, may not be prosecuted or convicted for any offense unless the juvenile court waives jurisdiction and certifies him for criminal prosecution. If such minor be over the age of seventeen (17) years, he shall be subject to a fine in accordance with the general penalty provision in Section 1.109 of this code. Any other person who violates any provision of this article, shall be guilty of a misdemeanor and upon conviction shall be fined in accordance with the general penalty provision in Section 1.109 of this code.
