There is hereby created a parks and recreation commission for the city to be composed of five (5) regular members who will be appointed by the city council. In addition to the five (5) regular members, a representative of the city’s youth association, the city’s community development corporation, city council and the city manager, shall serve as ex-officio, nonvoting members of the commission. Such ex-officio members shall advise and consult with the regular members of the commission with regard to issues presented to the commission; but shall not be considered with regard to quorum. Individuals serving the office appointed to the parks and recreation commission as ex-officio members shall not be covered by the limiting provisions.

The members of the parks and recreation commission shall be resident citizens of the City of Pottsboro, unless this qualification is waived by a majority vote of the city council. Two members shall be appointed to serve two-year terms, and three members shall be appointed to serve three-year terms. The initial term of office shall begin on May 1st of the year of appointment, except for the filling of vacancies and unexpired terms. All vacancies occurring shall be filled by appointment by a majority vote of the city council and such appointments shall be for the remainder of the term which was vacated. Members shall be limited to appointment for no more than two (2) complete successive terms.

The members of the parks and recreation commission shall organize and select their officers; and shall hold meetings regularly at least once in each month or quarter (or as needed); and shall designate the time and place of such meeting.

A majority of the regular members of the parks and recreation commission shall constitute a quorum for the transaction of business.

(a) 
The parks and recreation commission shall adopt its own rules and procedure and keep a record of its proceedings.
(b) 
Act in an advisory capacity in all matters pertaining to public parks and recreation.
(c) 
Consider the annual budget of the parks and recreation program and make recommendations with respect thereto the mayor/city administrator and the city council.
(d) 
Assist in the planning of parks and recreation programs; promote and stimulate public interest therein; and, to that end, solicit to the fullest possible extent the cooperation of the school authorities and other public and private agencies.
(e) 
Act on special requests for special use of any of the public parks or playground facilities after approval by majority vote of the city council.

Whenever it is deemed necessary by the parks and recreation commission to incur any expenses in performing the duties assigned to it, an estimate of such proposed expenses shall be submitted to the mayor/city administrator, and no debts of any kind or character shall be made or incurred by the commission or anyone acting for it, unless such expenditures have been specifically authorized by the mayor/city administrator prior to the time such obligations are incurred.

(a) 
)The use of the city park facilities located at Friendship Park, the Ball Park and James G. Thompson Park is restricted for activities such as baseball, soccer, T-ball, picnics, public functions, civic group activities, fundraisers and any other activities that would be approved by the city council.
(1) 
It shall be unlawful for any person to use or operate any motorized vehicle or motorcycle, go-cart, dirt bike, off-road motorcycle, four-wheeler, three-wheeler or any similar vehicle on any park or city property and is strictly forbidden. The city will utilize equipment for maintenance of city property as needed.
(2) 
It shall be unlawful to have an off-leash pet on any park property. Pets are strictly prohibited on athletic fields. This prohibition does not apply to a city operated dog park.
(3) 
It shall be unlawful for any person to bathe, swim or dive into the pond at the James G. Thompson Park.
(4) 
It shall be unlawful to use any watercraft in the pond at the James G. Thompson Park, including but not limited to kayaks, paddle boards, paddle boats, canoes and similar crafts.
(b) 
Any person who violates any provision of this section, or who fails to comply with any of the provisions contained herein, shall be guilty of a class C misdemeanor and upon conviction, shall be subject to a fine in accordance with the general penalty provision found in Section 1.109 of this code. Each day that such violation continues shall constitute a separate offense and shall be punishable accordingly.
(c) 
The prohibition contained herein shall not apply to any person or persons assisting, supervising, or attending another person under his/her direct supervision or control while that person is lawfully utilizing the park facilities in the manner set forth above.

(a) 
All city parks shall be closed to the public from 10:00 p.m. until 5:00 a.m., Sunday through Saturday.
(b) 
It shall be unlawful for any person to remain on public park property during the closed hours specified in subsection (a) hereof.
(c) 
The prohibition specified herein shall not apply to any person who engaged in organized activities authorized by the city.
