City Hall.
The building used as the city hall of the City of Panhandle, Texas, and all portions of it whether usually accessible to the public or not.
Police Department.
The building or any building used as or for the police department of the City of Panhandle, Texas, and all portions of it whether usually, accessible to the public or not.
Smoke and Smoking.
These terms are synonymous and include the carrying or holding of a lighted pipe, cigar or cigarette of any kind or any other ignited equipment or device used for the burning of tobacco, and the igniting of, emitting or exhaling the smoke from, a pipe, cigar or cigarette of any kind.

(a) 
A person commits an offense if he or she knowingly or intentionally smokes in the city hall of the City of Panhandle. It is not a defense that a person unconsciously, or out of habit, lit a smoking device.
(b) 
A person commits an offense if he or she knowingly or intentionally smokes in the police department of the City of Panhandle, Texas. It is not a defense that a person unconsciously, or out of habit, lit a smoking device.

Enforcement of the article shall be accomplished by a complaining witness filing a complaint in municipal court against any person accused of violation this article. The complainant must be able to identify the violator and must be willing to testify in court.

A violation of any of the requirements of this article shall constitute an offense punishable by a fine in accordance with the general penalty provision in Section 1.109 of this code.
