Any person found guilty of violating any part or portion of this article shall, upon conviction, be found guilty of a misdemeanor and assessed a fine in accordance with section 1.01.009 of this code, and each and every violation hereof shall be a separate offense.

(a) 
There is hereby created the position of city park director.
(b) 
The city park director shall be appointed by the city council, either on a part-time or full-time basis, at a salary to be set by the city council.
(c) 
The city park director shall be directly responsible to the city council.
(d) 
The city park director will be responsible for the total operation of all city parks, including but not limited to the following:
(1) 
All maintenance.
(2) 
All upkeep and appearance of parks.
(3) 
Hours parks are to be open, including authority to restrict hours and use of certain areas of parks for private or public purposes.
(4) 
Coordinate use of park areas for public or private use.
(5) 
Issue permits for use of parks.
(6) 
Coordinate use of parks by the public or private school system.
(7) 
Any other duties which may be delegated by the city council.

The following rules and regulations shall apply to all city parks:
(1) 
Each person, firm, or corporation using the public parks and grounds shall clean up all debris, extinguish all fires when such fires are permitted, and leave the premises in a good order and the facilities in a neat and sanitary condition.
(2) 
It shall be unlawful for any person, firm or corporation using such parks to either perform or permit to be performed any of the following:
(A) 
Willfully mark, deface, disfigure, injure, tamper with, or displace or remove any building, fences, tables, benches, fireplaces, railings, paving or paving materials, water lines or other public utilities or parts or appurtenances thereof, signs, notices or placards whether temporary or permanent, monuments, stakes, posts or other boundary markers, or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal.
(B) 
Bring in or dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage, or refuse, or other trash. No such refuse or trash shall be left anywhere on [except in] proper receptacles where these are provided; where receptacles are not provided, all such rubbish or waste shall be carried away from the parks by the persons responsible for its presence and properly disposed of elsewhere.
(C) 
Disturb the peace by use of any profane, obscene or blasphemous language, by the playing of loud music, or by the creation of a disturbance.
(D) 
Endanger the safety of any person by any act or conduct.
(E) 
Commit any assault or battery, or engage in fighting.
(F) 
Prevent any person from using any parks or any of its facilities or interfere with such use in compliance with this article and the rules applicable to such use.
(G) 
It shall be unlawful to drive or park any automobile except on a street, driveway or parking lot in any park, or to park and leave any such vehicle in any other place than one established for public parking.
(H) 
It shall be unlawful to use the tennis courts for any other purpose except that for which they are intended. Skateboards, bicycles, and two-, three-or four-wheel motorized units shall not be driven on any park property except streets, driveways and parking lots.
(I) 
It shall be unlawful to bring any dangerous animal into any park, and it shall be unlawful to permit any dog to be in any park unless such dog is on a leash not more than six feet long.
(J) 
It shall be unlawful for anyone to paste, glue, tack or otherwise post any sign, placard, advertisement, or inscription whatever, nor shall any person erect or cause to be erected any sign whatever on any public lands or roads adjacent to a park.

(a) 
Whenever any group, association or organization desires to use said park facilities for a particular purpose, such as picnic parties, reunions or other purposes, a representative of the group shall first obtain a permit from the city park director for such purpose. The city council may adopt an application form to be used for that purpose.
(b) 
The city park director shall grant the application if it appears the group will not interfere with the general use of the park by the public and that the group meets all other conditions. The application may contain a requirement for an indemnity bond to protect the city from any liability of any kind or character and to protect the city property from damage.

(a) 
Prohibition.
It shall be unlawful for anyone to possess glass beverage containers at the West City Park property at any time.
(b) 
Penalty.
Any person violating this section shall be deemed guilty of a misdemeanor, and upon conviction be fined in accordance with section 1.01.009 of this code.
