The laws of the state now in force or hereafter passed regulating the sale of vinous and malt beverages are hereby adopted for the city.

(a) 
Fee schedule.
There are hereby prescribed and levied annual license fees upon and there shall be collected each year from persons, firms and corporations carrying on business within the limits of the city in the amounts provided by the Texas Alcoholic Beverage Code, section 61.36.
(b) 
Payment of fee; proration.
All taxes or fees prescribed hereunder shall be paid in advance for one year unless such tax or fee be collected for only a portion of the year, and in such event the fee required shall cover the period of time from the date of the permit to midnight of August 31 next succeeding and only the proportionate part of the fee or tax levy for such permit shall be collected. The fractional part of any month remaining shall be counted as one month in calculating the fee to be due.
(c) 
Issuance of permit; state permit required.
Upon payment of the applicable tax or fee herein prescribed to the tax assessor and collector and exhibition to him of a permit duly issued by the state to the applicant or person paying such tax or fee, the tax assessor and collector shall in the name of the city issue and deliver to such applicant a permit to engage in business in the city of the character described in and authorized by the permit from the state held by such applicant and the city’s permit shall authorize the conduct of such business upon the premises described in the state permit and shall remain in force only so long as such state permit remains in force.
(d) 
Penalty.
Any person, firm or corporation who shall fail to pay any tax or fee prescribed in this section before engaging in any business for which the payment of any such fee and securing of any such permit is required by the terms of this section, or who shall engage in any such business without holding an unrevoked and unexpired permit from the city authorizing the same, shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine in accordance with section 1.01.009 of this code.

(a) 
It shall be unlawful for any person to sell beer or to offer beer for sale during the following hours:
(1) 
On Sunday at any time between the hours of 1:00 a.m. and 12 noon.
(2) 
On any day except Sunday at any time between the hours of 12 midnight and 7:00 a.m.
(b) 
Any person violating any of the terms of conditions of this section shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in accordance with section 1.01.009 of this code.
