(a) 
It shall be unlawful for any person to cause, suffer, allow, or permit any outdoor burning of trash, waste, rubbish, grass, brush, trees, or other matter within the city except as provided by section 5.03.002 of this article.
(b) 
It shall be unlawful for any person to conduct any outdoor burning in violation of any state statute, rule, or regulation, or in violation of common law.

(a) 
Required.
No person shall kindle or maintain any fire, or authorize such fire to be kindled or maintained, on any private land or on any public street, alley, road, or other public grounds within the city limits, without first having obtained a permit for such fire from the city secretary.
(b) 
Penalty; enforcement.
An offense under this section is punishable by a fine in accordance with section 1.01.009 of this code. The city police department and/or fire chief are authorized to enforce compliance with this section.
(c) 
No duty assumed.
In undertaking the enforcement of this article, the city is assuming an undertaking only to promote the general health, safety, and welfare of its citizens. The city is not assuming any duty or obligation or imposing any duty and/or obligation on its officers and/or employees. It shall not be liable in money damages or otherwise to any person who claims that the city and/or its officers and/or employees breached any such obligation and the breach proximately caused injury.
