There is hereby established the department of public works,
an executive department of the town. It shall consist of the director
of public works, who shall be the head of the department and who shall
report directly to the town manager. All employees of the department
shall perform their duties subject to the supervision of the director.
The director shall have the power to hire, discipline, replace, and
terminate all employees necessary for the proper operation of the
department, subject to the budget of the department as adopted and
amended from time to time by the town council.

The department of public works shall have the duty and responsibility
for the care, maintenance, and construction of all municipal buildings,
streets, roads, and drainageways of the town, and the construction,
operation, and maintenance of the town’s water system. The department
may perform its duties and responsibilities with personnel and equipment
of the department or by the use of independent contractors. All physical
properties of the town, including the water distribution system, not
assigned to any other department, shall be and are hereby assigned
to and are the responsibility of the department.

The town manager shall, from time to time, set the compensation
of the director of public works commensurate with the director’s
qualifications, hours devoted to the department, and the budget of
the town. The director of the department shall set the compensation
for all employees of the department commensurate with the employees’
qualifications, work history, and performance, subject to the town’s
budget as adopted by the town council.

The office of the director of public works is hereby created
by the town. The director of public works shall be appointed by and
report directly to the town manager or his/her designee. The director’s
duties shall include but are not limited to the planning and coordination
of all new public works projects of the town.
