No sump pump or other device which discharges drainage resulting
from rainwater, springs, wells, or other groundwater shall be connected
to the Borough of Milford sanity sewer system.
Prior to the sale of any property located in the Borough of
Milford, the seller thereof shall obtain from the Borough of Milford's
Director of Public Works, or/his designee, a certificate stating that
no sump pump or other device which discharges drainage resulting from
rainwater, spring, wells or other groundwater or prohibited discharge
is connected to the sanitary sewer system in violation of this section.
If the seller fails to comply with this or any subsection of this
section, the seller and the new owner after the sale will be jointly
and severally responsible for said compliance and all resulting penalties.
Certificates of sump pump compliance shall be in accordance
with the following procedures.
Applications for certificates of sump pump compliance shall
be filed with the Borough of Milford Sewer Superintendent by the seller
of the property at least 10 days prior to the change in ownership.
Applications shall be submitted on the forms supplied by the Borough
of Milford Sewer Superintendent and shall be accompanied by a fee
in the amount of $75.
Upon receipt of a completed application, the Borough of Milford
Sewer Superintendent or his/her designee shall conduct an inspection
of the property to determine compliance with the standards set forth
in this section.
In the event of a failure to comply with any subsection of this
section, including but not limited a failure to provide plans, comply
with the operating procedures, or to timely obtain a sump pump certificate,
or the refusal to allow inspection, the Sewer Utility may, upon 30
days' written notice to comply, seek imposition of a court-ordered
penalty per day for each day the offense continues.
