The position of city administrator is hereby created. The city administrator may be male or female, and the term “he,” “him” or “his,” as used herein, shall mean either gender. The city administrator will be the administrative head of the municipal government under the direction and supervision of the governing body. The city administrator will report to the mayor and city council but will be directly supervised by the mayor on administrative matters.

The city administrator shall be appointed by a majority vote of the city council for an indefinite term. He will be chosen by the council solely on the basis of his executive and administrative qualifications with special reference to actual experience in, or knowledge of, accepted practice in respect to the duties of his office, hereinafter set forth. At the time of his appointment he need not be a resident of the city or state, but he shall become a resident of the city within six (6) months of his appointment. No member of the city council shall hold a paid position with the city until he has been off the council for at least 30 days.

The city administrator shall serve at the pleasure of the city council. The city council may remove the city administrator from office, at any time, by a majority vote of its members. If requested, the city council shall grant him a public hearing within thirty (30) days following the notice of removal. During the interim, the city council may suspend the city administrator from all duties, but shall continue his salary until said removal becomes final. In the event the city administrator is removed, for any reason, he shall be paid any accumulated and unused vacation time and other benefits as prescribed by the city’s personnel policy. The city council may designate an interim to act in the absence or disability of the administrator.

The city administrator shall receive such compensation as may be fixed by the city council. The city administrator, as a city employee, is subject to the provisions of the personnel policies of the city as adopted by the city council.

The city administrator shall furnish a surety bond in an amount to be approved by the city council, said bond to be conditioned on the faithful performance of his duties. The premium of the bond shall be paid by the city.

Powers and duties of the city administrator shall be as follows:
(1) 
To devote his primary working time and attention to the affairs of the city, and be responsible to the governing body for the efficient administration of its affairs.
(2) 
To ensure that all laws and ordinances are enforced.
(3) 
To exercise supervision and control over all departments created by the governing body or that may hereafter be created by said governing body of the city, working through department heads. The city administrator shall be charged with filling vacancies in the city workforce. Hiring and removal of department heads shall be done with advice of the city council, and hiring and removal of subordinate employees will be done in consultation with department heads. The city administrator shall have the authority to eliminate nonessential positions, dismiss, demote, promote, discipline or suspend any employee, subject to the provisions of the personnel policy, funds allocated in the budget, and any state or federal statutes.

To attend all meetings of the governing body with the right to take part in the discussion, but having no vote, and shall be notified of all meetings of said governing body.
(5) 
To prepare and submit to the governing body, prior to the beginning of each fiscal year, a budget of anticipated revenues and proposed expenditures for the ensuing year, showing in as much detail as practical the estimated amounts required for the efficient operation of each department of the city government and the reasons for such estimated expenditures.
(6) 
To file the adopted budget document with the appropriate agencies, file all public notices required by the laws of the state to complete a city budget, and be responsible for administration of the budget after its final adoption.
(7) 
To secure an annual audit of all accounts and programs of the city and to prepare and submit to the city council, as of the end of the fiscal year, a complete report on the finances and administrative activities of the city for the preceding year.
(8) 
To keep the city council advised of the financial condition and projected future needs of the city, and to make proposals and applications for grant funds as may be available and determined by the city council to be beneficial to the city; supervise the administration of grants that are awarded to the city and file required reports.
(9) 
To supervise the purchase of all materials, supplies, and equipment for which funds are provided in the budget and purchase materials and supplies necessary for operation or maintenance of city services for amounts up to and including three thousand dollars ($3,000.00). The city administrator may issue policies governing procedures for purchasing within the administrative organization. After receiving authorization from the city council to do so, let and receive bids for purchases and contracts of fifteen thousand dollars ($15,000.00) or more and present them to the city council for approval. All sealed bids received shall be opened in public and thereafter shall be subject to public inspection. No purchase shall be made, contract let, or obligation incurred for any item or service which exceeds the current budget appropriation, without a supplemental appropriation by the city council. No contract shall be let except by the city council.
(10) 
To investigate the affairs of the city, or any department or division thereof, investigate all complaints in relation to matters concerning the administration of the government of the city, and regarding service maintained by the public utilities in the city. Ensure that high qualities of service are maintained by all employees of the city, and see that the provisions of all franchises, permits and privileges granted by the city are faithfully observed and, upon knowledge of any violation thereof, call the same to the attention of the governing body.
(11) 
To serve as the investment officer of the city, complying with state requirements for such officers and investing the funds of the city in accordance with the written investment policy as adopted by the city council.
(12) 
To act as public information officer for the city in dealing with requests from the media, publication of notices and news releases and open records requests. All officials and employees of the city will refer any open records requests or requests for information from media representatives to the city administrator.
(13) 
To serve as ex-officio member of all boards and commissions appointed by the council and all boards with which the city has contractual management obligations.
(14) 
To recommend to the governing body, in writing, for adoption, such measures and policies as he may deem to be necessary or expedient.
(15) 
To work directly with outside consultants in developing solutions to identified needs.
(16) 
To do and perform such other duties as may be prescribed by the city council not inconsistent with federal or state law, or city ordinances.

In case of accident, disaster, or any other circumstance creating a public emergency, the city administrator may award contracts and make purchases for the purpose of meeting the emergency. He shall file, within seventy-two (72) hours, with the city council a certificate describing the emergency and showing the necessity for such action, together with an itemized account of all expenditures.
