The city signifies its willingness and intention to act as permanent
trustee for the perpetual care and upkeep of the lots and graves in
Oak Hill Cemetery.

Any person desiring to have the city act as trustee for him
or those deceased persons in whom he has an interest or to whom he
may feel attached, and who is buried, or will be buried, in the Oak
Hill Cemetery, shall have the right to deposit funds equal to or in
excess of the minimum amount required, and the acceptance of such
funds by the city shall constitute a permanent and perpetual trust
fund for the burial lot or grave in Oak Hill Cemetery designated at
the time of the making of such deposit.

Any person desiring to deposit funds for the permanent care
and upkeep of any burial lot, grave or graves shall be required to
deposit an amount established by city council per square foot of surface
area within any such burial lot, grave or graves; nothing shall prevent
any person from depositing any amount in excess of the established
amount per square foot of such area.

Upon the acceptance by the city of any such deposit, its secretary
or mayor shall issue a certificate to the person advancing the funds.
The certificates shall recite the amount advanced, by whom, and the
location, as nearly as possible, of the lot, grave or burial place
to receive perpetual care and upkeep, and such other and further information
as may be deemed proper.

The city secretary shall hereafter keep a permanent book in
which shall be kept in alphabetical order the names of all persons
advancing funds for the perpetual care and upkeep of lots, graves
or burial places, the amount advanced, and, insofar as possible, the
location of the lots and graves, and the name of the persons buried
therein.

The city shall invest and reinvest all funds advanced to it
for the purposes herein set forth in bonds and securities authorized
by law, and the interest, revenue, or other accrual or increase of
the funds advanced for specific lots, graves or burial places shall
be first used for the maintenance, care and upkeep, in a first-class
condition, of the particular lot, graves or burial place for which
the advancement was originally made. However, in the event of the
accrual of a reasonable excess of revenue from such specific fund
and the accumulation of a greater amount than is necessary for the
faithful accomplishment of the trust and purpose herein provided for,
such excess may, in the discretion of the city, be used to beautify
the whole cemetery generally; provided, however, the original amount
shall forever remain and be kept intact as a principal trust fund.

The city shall also receive gifts, grants and donations from
any source for the benefit of Oak Hill Cemetery. Any donor so desiring
to do so may deposit funds with the city as a perpetual fund for the
permanent beautification, upkeep and care of the cemetery generally,
and such funds shall be invested and reinvested as authorized by law,
and the revenues therefrom shall be used for the beautification, upkeep
and care of the cemetery generally, as the city shall in its discretion
direct.

Nothing herein shall deprive any person having an interest in
a grave or burial place from beautifying or caring for the same individually
or at his expense, under such rules and regulations as the city may
provide.

The mayor is authorized to execute all contracts with any person
for the carrying out of the purposes of the trust herein accepted;
however, investment of funds shall be made only after such investments
shall have been approved by a majority of the city council.
