It is hereby declared to be a nuisance and no person shall,
without a permit, keep or maintain at their residence any of the following
animals within the city:
(1) Horse,
colt, jack or mule, donkey or burro;
(3) Cattle,
including ox, steer, bull, cow or calf;
(5) Bees,
or hives of bees; and

(a) After
giving five (5) days’ notice in the newspaper, the animal control
officers may sell at public stockyards any impounded animal covered
by ordinance. Redemption by the owner or his agent is possible any
time prior to sale by paying an impounding fee in the amount established
by city council. In the case of redemption, all advertising fees shall
be paid by the owner. All moneys so received by virtue of sale of
such animals shall be turned over to the city for deposit into the
city’s general fund.
(b) Any
animal covered under this section not sold or redeemed may be disposed
of by the animal control officers or county sheriff’s department
in whatever manner is in the best interest of the city.

Any person desiring a permit required by this division shall
file a written application therefor with the city, which application
shall affirmatively show that the applicant has facilities for keeping
such livestock and fowl in quarters meeting the standards of this
division. Each application shall be set to expire on December 31 of
the year issued unless sooner revoked and shall be accompanied by
a permit fee in the amount established by city council. Scholastic
and county extension agent projects shall be exempt from this section.

The annual permit issued under this division shall be valid
and effective for twelve (12) months from the date of issuance, unless
sooner revoked.

Every keeper of any livestock or fowl shall confine the same
in an enclosure sufficient to prevent their running at large, and
such enclosure shall be maintained in a clean and sanitary condition
at all times. No pen, stall or other facility used for keeping livestock
or fowl as authorized by a permit issued under this article shall
be so located as to allow the livestock or fowl confined therein to
come within one hundred (100) feet of the exterior limits of any dwelling,
other than a dwelling occupied by the holder of the permit.

Every keeper of any livestock or fowl shall cause the litter
and droppings therefrom to be collected daily in a container or receptacle
of such a type that, when closed, is ratproof and flytight, and after
each collection shall cause such container or receptacle to be kept
closed. At least once a week each keeper shall cause all litter and
droppings so collected to be disposed of in a way as not to permit
fly breeding.

All feed provided for livestock and fowl shall be stored and
kept in a ratproof, flytight building, box, container or receptacle.

Premises whereon livestock or fowl are kept or maintained shall
be subject to inspection by the animal control officer at any reasonable
hour of the day.

Any variance requested by the owner to the provisions of this
division shall require city council approval.
