(a) 
There is hereby created a planning and zoning commission for the city, hereinafter referred to as the “commission” (as provided in section 211.007 LGC), composed of five regular members and up to five alternate members, each of whom shall be a resident taxpaying citizen of the city.
(b) 
Regular members shall have voting rights at all meetings.
(c) 
In the event of the absence of a regular member at a meeting, an alternative member shall be chosen by a random method to act with full voting rights in the stead of each absent regular member at all meetings. Alternate members shall have all rights and duties of regular members, except for voting.

(a) 
The mayor shall appoint the regular members and alternates of the commission from a list of nominees submitted by the city council, and each person so appointed must be approved by the city council before becoming a member thereof.
(b) 
The terms of the members first appointed shall be staggered and fixed so that the terms of approximately one-third of the members will expire on December 31 of each year, the minimum term being no less than one full calendar year. After the expiration of the terms of the original members and alternates, the terms of members shall be three years.
(c) 
Vacancies of regular members shall be filled for the unexpired terms from among the alternates. Vacancies of alternates shall be filled by appointment of any qualifying citizen by the mayor for the unexpired terms.

The city council may remove a member of the commission at any time for cause.

Statutes of the state authorizing and empowering cities to regulate the platting and recording of subdivisions or additions situated within the corporate limits, and establishing extraterritorial jurisdiction within one-half mile of the city (section 212.004 LGC), and as amended, are hereby adopted for and on behalf of the city; and the city, acting through its duly authorized officials, shall have all the rights, powers, privileges, and authority authorized and granted by and through said statutes.

All department heads, officials of the city, and technical consultants employed by the city shall be available to the commission for advice and consultation; and they shall cooperate with and render such services for the commission as shall come within the scope of the duties of such department heads and officials. All such department heads and officials shall attend meetings of the commission upon the written request of the commission or its duly authorized official or officials.

(a) 
The planning and zoning commission shall elect one of its members as chairman and one as vice-chairman, and shall elect a secretary, who need not be a member of the commission.
(b) 
The commission may determine the time and place of its regular meetings, and the chairman may call special meetings.

(a) 
The planning and zoning commission shall have the power and it shall be its duty:
(1) 
To make studies and project plans for the improvement of the city with a view for future development and extension, and to recommend to the council all matters for the development and improvement of the city’s facilities, and shall pass upon the application for plats requested as provided by state law.
(2) 
To make plans and maps of the whole or any part or portion of the city and of land outside the city, which, in the opinion of the commission, bears a relation to the planning of the city, and to make changes in, additions to, and extensions of such plans or maps when it deems the same advisable.
(3) 
To confer with and advise private property owners pertaining to location and erection of private structures with the view of having same conform to the overall city plan.
(4) 
To act with and assist all other municipal and governmental agencies, and particularly the city council, in formulating and executing proper plans of municipal development and growth.
(5) 
To plan and recommend the locations, scope, character and standards for streets, roads, alleyways, viaducts, bridges, subways, parkways, airports, automobile parking places, utilities, public buildings, schools, parks, playgrounds, railroads, water, lights, sanitation, sewerage, sewage disposal, drainage, flood control, transportation, transportation terminals, communication, marketing and shipping facilities, power and other facilities; and for the removal, relocation, widening, extension, narrowing, vacating, abandoning or changing of use of any of the foregoing public places, facilities and utilities.
(6) 
To select and recommend to the city council routes of streets, avenues, and boulevards, including the opening, widening, and abandoning of the same or of any alley, or the changing thereof to conform with the city’s system present and future, with reference to traffic, land use and public facilities.
(7) 
To investigate, evaluate, and report to the city council upon the layout or platting of any new subdivision of the city, or of property situated within one-half mile of the city limits, and to recommend the approval, disapproval or modification of all plans, plats, or replats of additions within the city limits or within one-half mile of same, or the rejection of either.
(8) 
To recommend to the city council plans for clearance of slums and blighted areas, the prevention of the spread of blight and dilapidation and improvement of housing conditions.
(9) 
To make any recommendations concerning future zoning plans.
(10) 
To recommend, annually, a budget for capital improvements at the appropriate time established by the city council, setting forth detailed recommendations for financing public improvements for the forthcoming year and estimate the requirements for the subsequent five-year period.
(11) 
To recommend to the city council, from time to time, passage of such ordinances as may be necessary to carry out the commission’s program.
(b) 
The commission shall also have all other powers and duties conferred by state law upon city planning and zoning commissions.
