When used in this article the following words shall have the
respective meanings:
Fireworks.
Includes firecrackers, torpedoes, skyrockets, Roman candles,
aerial salutes, American or Chinese bombs, sparklers, squibs, rockets,
tablets or other devices commonly used or sold as fireworks which
contain nitrates, chlorates, oxalates, sulfides or lead, barium, antimony,
arsenic, mercury, nitroglycerin, phosphorus, or any compound containing
any one, and also includes any explosive commonly known as fireworks
which contains explosives or inflammable compound.
Person.
An individual, male or female, a partnership or unincorporated
association, and a corporation.
Pyrotechnics.
Includes fireworks, signal lights, railroad track torpedoes,
flashlight compositions, or other devices or devices or compositions
used to obtain visible or audible pyrotechnic display, and includes,
also, fire balloons having burning material of any kind attached thereto.

(a) No
person shall sell, give away, use, discharge or explode any fireworks
within the corporate limits [of the city].
(b) Exception: The prohibition stated above in subsection
(a) shall not apply to the possession or use of fireworks at an official event sponsored or approved by the city, whether it is a fireworks show or a designated fireworks usage area made available for the general public upon dates, times, and location specified by the city.

No person shall knowingly permit the explosion of fireworks
upon property owned or occupied by that person within the corporate
limits.

No parent, guardian or person in loco parentis shall permit
his or her child or ward to discharge or explode fireworks within
the corporate limits.

No person shall have, keep, store, use, manufacture, sell, handle,
offer for sale or expose for sale pyrotechnics within the corporate
limits.

No person shall manufacture small arms ammunition within the
corporate limits. This provision shall not be construed as prohibiting
the hand loading of small arms ammunition for private use and not
for resale.

However, nothing in this article shall prohibit:
(1) The
possession or use of signaling devices for current daily consumption
by railroads, motor carriers and others required by law to have them;
(2) The
possession, sale or use of normal stocks of flashlight compositions
by photographers or dealers in photographic supplies;
(3) The
use of blank cartridges for signal purposes in athletic contests,
sporting events, theatrical productions, public parades, and ceremonies
or by police or military organizations nor shall this article be held
to prohibit the sale of blank cartridges for such purposes.

Any person, association, or corporation desiring to put on a
display of fireworks, which display the general public may attend,
may, upon petitioning the city council and with the approval of the
council, discharge or explode fireworks within the corporate limits
under such conditions and at such place as the city council may direct.

Any person who shall violate a provision of this article shall, upon conviction, be guilty of a misdemeanor and shall be punished by a fine as provided in section
1.01.009.
