An “itinerant merchant” or an “itinerant vendor” is herein defined as any person who goes from house to house or from place to place or who may peddle his goods or merchandise from a temporary location in the city soliciting, selling, or taking orders for or offering to sell or take orders for any goods, wares, merchandise, services, insurance, photographs or magazines.

Any person, firm, or individual who shall violate any of the provisions of this article shall be guilty of a misdemeanor and upon conviction shall be fined in any sum as provided for in section 1.01.009 of this code. Each and every day’s violation shall constitute a separate offense.

The provisions of this article shall not apply to the sale or soliciting of orders for the sale of milk, dairy products, bakery products, vegetables, poultry, eggs, and other farm and garden products which have been raised or produced by the vendor; daily deliveries of milk and bakery and other food products to retail merchants; newspaper distribution when headquarters are maintained in the city; sales made to dealers by commercial travelers or sales agents in the usual course of business; sales made by distributors of any merchandise; sales made under authority and by order of law; sales of goods or merchandise produced, manufactured, or originating within a ten (10) mile radius of the city; or sales by merchants who reside in the city or within ten (10) miles of the radius of the city.

It shall be unlawful for any peddler or hawker of goods or merchandise to enter upon premises owned or leased by another and willfully refuse to leave such premises after having been notified by the owner or possessor of such premises, or his agent, to leave the same.

It shall be unlawful for any itinerant merchant or vendor to engage in any activity mentioned in section 4.02.001 without having first applied for and obtained a permit to do so from the city secretary’s office.

Each applicant for a permit under this article shall be charged a permit fee as provided for in the fee schedule found in appendix A of this code. Applicants demonstrating a valid claim of interstate commerce shall be exempt from the fee requirements herein, but shall be otherwise regulated by the provisions of this article.

Each permit issued under this article shall contain the following:
(1) 
The name of the applicant and his address;
(2) 
A physical description of the applicant;
(3) 
The date the permit was issued.

It shall be unlawful for any itinerant merchant or vendor to engage in any activity for which a permit is required by this article unless he carries such permit on his person while so engaged.

All permits issued under this article shall be valid from the date shown thereon for a period of one (1) year.
