The uses that are permitted in each zoning district are summarized
in two tables in this Article, one for residential districts and the
other for nonresidential districts. The uses that are allowed in each
district as of right are designated in these tables by the symbol
“X.” Additional uses in each district that may be allowed
by the City Council under certain conditions are designated by the
symbol “CC” (see ARTICLE V, SECTION 3 for approval process
guidelines). Certain uses and certain subtypes of uses which are listed
in these tables as allowed, or allowed with City Council approval,
are also subject to particular restrictions in particular districts
as detailed in the Section concerning each district. Because it is
not possible to enumerate every conceivable land use, the City Manager
shall determine whether a proposed use is included or excluded from
the scope of the uses listed in these tables and the provisions concerning
particular districts as provided in Article II, Section 2 [Article
II, Section 3] of this ordinance.

R-1 is restricted to a single guest house or “mother-in-law”
dwelling unit attached to the single-family dwelling unit only. Exteriors
of dwelling units in R-1 shall be constructed of brick, rock, stucco,

R-2 is restricted to the same requirements as in R-1, and additional
uses include Townhomes, Condominiums, Apartments, Duplex’s,
Barndominium and Loft Apartments only, as long as all lot dimension
and setback distances are maintained.
(3) DSFA in
R-3 allows for the same requirements as in R-1 and R-2, as long as
all lot dimension and setback distances are maintained.
(4) DSFD in
R-1 allows for a single guest house or “mother-in-law”
suite only. Dwellings in DSFD/R-1 prohibits dwelling units with exterior
construction consisting solely of metal or cinder block exteriors
(“agriculture building equivalent”). Exteriors of dwelling
units in R-1 shall be constructed of brick, rock, stucco, wood or
wood equivalent siding, or vinyl siding,[.]
(5) DSFD in
R-2 shall follow the same requirements as in R-1, and includes the
addition of Manufactured Homes.
(6) DSFD in
R-3 shall follow the same requirements as in R-1, and excludes Manufactured
Homes outside of Manufactured Home Parks.
(7) DTF is authorized
in R-1 if the DTF was in place prior to adoption of this amended ordinance
(Nov 2016). No new DTF may be constructed in R-1.

C. Restrictions
on Particular Uses.
1. Crop cultivation
is limited to tracts of land that are 5 acres or greater, excluding
home gardens.
2. Any keeping of animals must conform to city code (See Chapter
2).
3. A modular
home shall bear a State of Texas Compliance Decal in accordance with
the Texas Department of Labor and Standards Rules. All modular homes
shall be affixed to a permanent foundation in accordance with the
City Building Code requirements. Any space variation between the finished
floor elevation and the foundation shall be concealed.
4. Exteriors
of dwelling units in R-1 shall be constructed of brick, rock, stucco,
wood or wood equivalent siding, or vinyl siding.
5. Sidewalks,
where established, shall be kept free at all times of items that my
[may] block public use of the sidewalk.

These districts are composed of areas similar to the R-1 districts,
except that greater intensity of land development is permitted through
the inclusion of dwellings, single-family attached (DSFA) and dwellings,
single-family detached (DSFD), with restriction as noted in the Table

be compatibly integrated with allowable single-family dwelling units
by spatial and architectural design, limits on the overall intensity
of development, and minimum yard and lot area requirements.

C. Restrictions

1. No manufactured
home shall be admitted to any manufactured home park unless it meets
the minimum standards and requirements of the “American Standards
for Installation in Mobile Homes of Electrical, Heating and Plumbing
Systems,” and the minimum regulations of Flatonia Manufactured
Home Ordinance.
2. A manufactured
home park shall conform to the minimum standards and regulations as
stated in Flatonia Manufactured Home Ordinance.
3. Sidewalks,

A dwelling unit(s) is authorized on the CBD street level; however,
it must occupy the rear (nonstreet front) of the commercial structure,
shall not exceed 50% of the street level floor’s total square
footage, and meet all requirements of the adopted International Codes
(I-Codes) published by the International Code Council (ICC), and the
adopted National Electrical Code. Minimum square footage per dwelling

This district is intended to provide for the intense commercial
activities of the central business district or central trading area
of the City and certain residential uses. This district establishes
the character of the City by serving the tourists as well as the residents
of the City.

C. Restrictions
on Particular Uses.
The following restrictions apply
to dwelling units in the CBD:
1. Commercial
uses listed in [Article III,] Section 7, Table of Permitted Uses are
the only authorized uses for CBD structures. At a minimum, the commercial
use must incorporate at least 50% of the street-level square footage
of the structure, shall be fronted to the main street side of the
structure, and the street level commercial use shall not be converted
to any use other than solely for authorized commercial business.
2. No street-level
dwelling unit shall occupy more than 50% of the gross street-level
square footage of the CBD structure.
3. Dwelling
units in a CBD structure shall meet all requirements for DSFA or DMF
as applicable, and all requirements of the adopted International Codes
(I-Codes) published by the International Code Council (ICC), and the
adopted National Electrical Code.
4. Minimum square
footage for any dwelling unit in the CBD is 400 square feet.
5. Occupants
of dwelling units in the CBD shall not have in the public view any
personal items (laundry, barbeque pits, bicycles, etc.), political
flyers or banners, advertisements, or any item that would detract
from the commercial atmosphere of the CBD as determined by the City
Manager. Potted plants and the United States and Texas Flags are authorized
for display.
6. Sidewalks
in the CBD are designed for heavy pedestrian traffic. No CBD business
or occupant of a dwelling unit in the CBD shall interfere with pedestrian
use of the public right-of-way sidewalks. No unattended personal items
are authorized on CBD sidewalks. Commercial display of items or public
seating on sidewalks in the CBD is authorized to the extent that it
does not interfere with the public use of the sidewalk, including
wheelchairs (manual or powered).
7. Dwelling
units for rent, let, lease, etc., must contain within the lease agreement
a landlord to leasee disclosure, acknowledged in writing by the leasee,
that habiting a dwelling unit within the CBD comes with inherent noise
(e.g., truck traffic, live music, etc.) exceeding levels found in
residential districts at hours outside normally accepted business
hours. Leasees shall not make unnecessary noise complaints against
CBD businesses engaging in their normal business operations.
8. Parking in
the CBD, unless specifically addressed as private and entirely within
the lot lines of a CBD property, is on City-controlled rights-of-way.
No CBD structure has “designated” parking on City right-of-way
streets. Occupants of dwelling units in the CBD shall remove personal
vehicles from the City right-of-way street parking during normal business
hours (Mon–Fri, 8:00 a.m.–5:00 p.m.) to promote commercial
business in the CBD.

The GC districts are located along the principal arterial streets,
adjacent to both residential and other nonresidential districts. They
are areas suitable for general retail trade and a wide variety of
other commercial uses at medium land use intensity. The district regulations
are designed to encourage these uses, while also protecting the abutting
and nearby residential areas.

usually separated from residential districts by business districts
or natural barriers and located where traffic infrastructure is available.
The district regulations are designed to allow a wide variety of industrial
activities, subject to limitations designed for mutual protection
of adjacent land uses.

These districts are intended to be left undeveloped, except
for park facilities. Land unsuitable for development because of flood
susceptibility or steep slopes is generally classified under this
district. Park facilities or beautification efforts are consistent

A. Purposes.
These districts are intended to encompass those portions of
the City with historic resource value. The area within the Historic
district is subject to the requirements of two land use designations:
the underlying designation and the historic characteristics of the
district.

on Particular Uses.
All exterior construction, restoration,
alteration or demolition within the district is subject to the provisions
of the Historic Preservation Ordinance.

A. Purposes.
This district can comprise a specified area or areas or specific
properties that are generally used for governmental or public purposes.
This district can be composed of specified areas or properties or
storage sites or facilities owned by governmental entities, such as
city, county, state, school districts, or any other public purpose
district currently existing or to come into existence in the future,
including but not limited to the following, city hall or annex, fire
stations, police stations, school and school administration buildings,
school stadia or sports fields and facilities, auditoriums, assembly
halls, convention halls or centers, theatres, churches, and cemeteries.
B. Required
Lot Dimensions.
This district shall comply with the setback
and other Article III regulations applicable to the corresponding
underlying zoning district or classification in which the specified
area or parcel of property is situated at the time of the designation
of the area or property as part of the overlay district. Where a particular
parcel abuts more than one type of district, the setback requirements
for the abutting district shall be applicable to each corresponding
side. For example, a school that abuts a residential zone on one side
and a commercial one on the other side would be subject to the residential
setback requirements only on the portion of the property that abuts
the residential zone and to the commercial setback requirements to
the portion of the property that abuts the commercial zone.
