This division may be known and may be cited as the police reserve force ordinance of the city.

There is hereby created a police reserve force. The number of officers will be left to the discretion of the police chief with the approval of the city council.

Each member of the police reserve force shall be in good physical condition, of good character and not less than eighteen (18) years of age.

Appointments to the police reserve force shall be made by and at the discretion of the chief of police.

Following approval by the city council, the term of each member of the police reserve force shall be two (2) years, with all terms to expire on the date of expiration of the term of the mayor.

Any member of the police reserve force may be discharged at any time with or without cause and without a hearing by the city council, upon recommendation of the chief of police to the city council.

The police reserve force shall function under the immediate direction of the chief of police.

Before entering upon any duties as a member of the police reserve force, each member shall take and subscribe to the same oath or affirmation as provided by the constitution of the state to be taken and subscribed by all appointed municipal officers.

After subscribing to the oath of office, each member of the police reserve force shall be issued an official commission card signed by the mayor. The card shall be retained in the personal possession of the member at all times.

When called into service by the chief of police, reserve police officers shall act only in a supplementary capacity to the regular police force, and the reserve police force shall in no case assume the full duties of regular police officers without having first complied with all requirements for such regular police officers.

(a) 
Following appointment to the police reserve force, no member may carry a weapon or otherwise act as a peace officer until such person has been approved by resolution of the city council.
(b) 
Members of the police reserve force may carry a weapon only when authorized by the chief of police, and when discharging official duties for the city police department.

Membership in the police reserve force shall not constitute employment in the regularly constituted city police department, nor shall any member of the police reserve force be entitled to any right or privilege or compensation or any other similar right or privilege of members of the city police department except as authorized by sections 141.007 and 142.003 V.T.C.A., Local Government Code. Reserve officers shall be eligible for death benefits as set out in 003 V.T.C.A., Local Government Code chapter 615.

(a) 
The chief of police shall determine the program for training members of the police reserve force in police work. The training program shall be submitted for approval to the city council before it shall become the approved training requirements for members of the police reserve force. The training requirements of the police reserve force shall meet the criteria set by the state.
(b) 
The police reserve force may adopt its own bylaws and rules or regulations and any and all amendments thereto; however, all such standards shall at all times be subject to approval by the city council, and shall not conflict with any provisions of this division, other ordinances of the city, state law, rules of the police department or the orders of the chief of police.

No member of the police reserve force shall receive any compensation from the city for services as a member of the police reserve force, except as may be provided from time to time by resolution of the city council.

The members of the police reserve force shall furnish their own uniforms and other necessary equipment without reimbursement from the city, except to the extent, if any, specifically provided for in the annual budget of the city.

The financial accounts of the police reserve force shall be subject to audit at any time the city council may designate. The fiscal officer of the police reserve force shall present all records and books of the police reserve force for audit when requested to do so by the city council.

Each member of the police reserve force shall promptly, after being appointed and prior to taking the oath of office, execute and deliver to the city secretary an instrument in a form to be approved by the city attorney, releasing the city from all liability for any injury or death of such member in the line of duty as a member of the police reserve force, except only such liability, if any, as shall be attributed to gross negligence on the part of the city.
