The following activity as hereinafter described and set forth within the framework of this division constitutes the work product of the park board of the town and the recommendations made by the same to the board of aldermen to the end that the use of public parks within the town shall be in keeping with the safety, health, morals and general welfare of the populace in general and moreover designed to protect, preserve and defend the public peace.

It is hereby declared a misdemeanor and any person convicted of a violation of the following provisions shall be deemed guilty of a misdemeanor and therefore subject to a fine upon conviction of up to two hundred dollars ($200.00) per day, with each and every day constituting a separate violation.

Compliance with rules and regulations of this division is a condition of the use of the public parks and recreation areas of the town, and any person charged with the supervision of any park or recreation area and all peace officers shall have the right and power to arrest any person who may violate any of the rules, regulations, orders or requirements of the park and recreation board or any ordinance or general law relating to the maintenance of the park and recreation areas of the town located within or without the corporate limits of the town.

It shall be unlawful for any person to cut, deface or mark any park property, or to handle, cut, pluck, injure, damage or destroy any flower, shrub or tree, or to deface, mark, injure, damage or destroy any natural or artificial improvement in any park or recreation area.

It shall be unlawful for any person to use or enter upon any park or recreation facilities for which a fee or deposit is charged, as approved by the board of aldermen, without first having paid such fee or deposit. Payment of such fee or deposit shall entitle the person to use the facilities for the sole purpose for which the facility is intended or designated. Any deposit shall be for the purpose of damage repair or cleanup necessitated by the use of the facilities.

It shall be unlawful for any person to frighten, annoy or injure, or attempt to frighten, annoy or injure, any animal or bird in any park or recreation area.

It shall be unlawful for any person to deposit paper, glass, metal, litter or trash of any description on any lawn, driveway, path or other place in any park and recreation area except in receptacles provided therefor.

It shall be unlawful for any person to display any advertising matter by signs or to distribute advertising matter by signs [sic] or to distribute advertising matter of any character within any parkways, medians, parks, or other recreation areas of the town without written permission of the town park and recreation board.

It shall be unlawful for any person to sell or offer for sale any goods, wares, services, or merchandise within any parkways, medians, parks, playgrounds, or other recreation areas without permission of the park and recreation board.

It shall be unlawful for any person to practice golf in any portion of a park or recreation area not designated for that purpose; provided, however, that the practice of golf with knit or plastic balls may be permitted in any open area not specifically designed or designated for some other specialized activity.

It shall be unlawful for any person to use any boisterous, insulting or profane language or to conduct oneself in a disorderly, lewd, obscene or lascivious manner in any park or recreation area.

It shall be unlawful for any person to enter any portion of a park or recreation area which is designated as restricted, or to enter any area during the hours of the day when such area is not open to the public, or to enter at any time any park and recreation area which is closed for the season. Hours during which the area is open to the public shall be posted by the town park and recreation board. Unless otherwise posted by the park and recreation board, the hours during which parks are open to the public are 7:00 a.m. to 6:00 p.m. Parks will close during daylight savings time at dark.

It shall be unlawful for any owner or person in control of any dog to keep or permit the same in or about any park or recreation area unless such dog is kept under restraint at all times by means of a leash.

It shall be unlawful for any person, without written permission of the town park and recreation board, or without a valid current contract with the town, to ride any cow, horse, mule, fowl or domesticated animal in or upon any park or recreation area not designated by the park and recreation board for such purpose, or to tether or pasture, or allow or cause to be tethered or pastured, any cow, horse, mule, fowl or domesticated animal in or upon any park or recreation area.

It shall be unlawful for any person to wash a vehicle in any park or recreation area not designated for that purpose.

It shall be unlawful for any person to fly a kite or propel or guide a model airplane in any park or recreation area traversed by high-voltage transmission lines.

It shall be unlawful for any person to carry on or about his person or discharge any gun, pistol or firearms of any kind, including air guns, within or across any park or recreation area not designated for that purpose.

It shall be unlawful for any person or persons to wade, swim, fish or boat within any park or recreation area not so designated.

It is unlawful for any person to possess alcohol within any portion of any park or recreation area. A sign shall be conspicuously posted at each entrance to such park or recreation area prohibiting the possession of alcohol as follows: “POSSESSION OF ALCOHOL WITHIN THESE PREMISES IS PROHIBITED UNDER SECTION 1.09.079 OF THE CODE OF ORDINANCES OF THE TOWN OF EDGECLIFF VILLAGE. PERSONS IN VIOLATION MAY BE FINED UP TO $500.00.”

No sale or offering to sell shall be made from any mobile vending vehicle of any ice cream, frozen desserts or other edible or potable substances in any park or other municipal recreation facility.

(a) 
It shall be unlawful:
(1) 
For any person to drive or propel any vehicle in, over or through any park or recreation area except along and upon park drives, streets or boulevards or other areas designated for driving purposes.
(2) 
For any person to stop, stand or park any motor vehicle or to permit any such motor vehicle to so stop, stand or park within the confines of any park or recreation area, except such as may be necessary or incidental to park visits or such as may be due to accidental or temporary mechanical failure of such vehicle or such as may be occasioned by the order of any police officer, peace officer, park ranger, or person charged with the supervision of any park or recreation area.
(b) 
If any motor vehicle is found within the confines of any park or recreation area in violation of any prior provisions of this section and the identity of the operator of such vehicle cannot be determined, the owner or person in whose name such vehicle is registered shall be held prima facie responsible for such violation.
