There is hereby created the office of the electrical inspector in charge which shall be the electrical inspector of the City of Friona, and within which may be assistant electrical inspector.
(1) 
Requirements.
The electrical inspector shall be competent person of good moral character; he shall have had adequate knowledge of current and approved methods and practices relating to electrical installations.
(2) 
Appointment.
The electrical inspector shall be appointed by the city manager with the approval of the city council and shall hold office until his successor is appointed and duly qualified. Assistant inspectors may be appointed by the city council whenever occasion demands.
(3) 
Salary.
The salary of the electrical inspector and his assistants shall be fixed by the city council.
(4) 
Bond.
The electrical inspector shall execute a bond to the City of Friona as the city council may direct.

(a) 
The electrical inspector shall inspect and test electrical installations and systems in all consumer installations when he has reason to believe the same are unsafe, improper and do not comply with applicable ordinance.
(b) 
The electrical inspector shall inspect all installations, alterations, and repairs of electrical work in consumer installations as hereinafter set out.
(c) 
The electrical inspector shall, upon determining that unsafe, improper or unlawful consumer installations exist, immediately notify the owner of said premises or his agent, and/or the electrician performing work on said premises, in writing, specifying the exact deficiency existing, and shall allow said parties to reasonable time to correct said deficiency. If corrective action is not begun immediately, or if the deficiency is not corrected within the prescribed time, then the electrical inspector shall, if he believes public welfare endangered, order the electricity supply to said premises to be discontinued.
(d) 
The electrical inspector and his assistants shall, when in the performance of their duties, and as far as may be necessary for the performance of their duties, have the right to enter any consumer’s building at all reasonable hours for the purpose of making any tests or inspections of the electrical wiring and appliances therein contained.
(e) 
The electrical inspector shall keep or cause to be kept a record of permits, licenses, and inspections required under this article; he shall also keep a record of all condemnations of electrical installations.
(f) 
The electrical inspector shall stop the installation, alteration, operation or repair of any electrical work on or in consumer’s premises whenever, in the inspector’s opinion, the work is being done in a reckless, careless or unsafe manner or in a manner which violates the provisions of this article. Upon determining that particular work should stop, the inspector shall post a notice to that effect on the consumer’s premises and thereafter no person shall proceed with the installation until the inspector has cancelled the stop work notice.

The city manager may remove from office the electrical inspector or any of his assistants for incompetency or neglect of duty.

Neither the electrical inspector nor any of his assistants shall, when acting in good faith and without malice, be liable for damages arising by reason of duties performed under the provisions of this article.

There is hereby created a board of electrical examiners for the City of Friona.
(1) 
Membership.
The board of electrical examiners shall consist of the following members who shall serve without compensation: A master electrician, a journeyman electrician and five other persons, one of whom is a representative of electric utility or electrical distributor classification, who in the opinion of the city council are qualified through education and practical experience to perform the duties of electrical examiner.
(2) 
Appointment.
Members shall be appointed by the city council for a term of two years; provided, however, that one-half of initial appointments shall be for terms ending January 1, following date electrical ordinance becomes effective. Vacancies shall be filled by appointment for the unexpired term of the departed member.
(3) 
Removal.
When good cause exists, a member may be removed by the city council.
(4) 
The electrical inspector shall serve as secretary to the board and shall keep a complete record of all proceedings of the board.

(a) 
The board shall meet as soon after appointment as possible and select a chairman; it shall thereafter meet at least once each month or upon call of the chairman.
(b) 
The board shall adopt rules and regulations for the examination and re-examination of applicants for electricians’ licenses.
(c) 
The board shall submit to the city council written recommendations and suggestions for the improvement, enforcement and administration of this article.
(d) 
The board shall cause the issuance of appropriate certificates and licenses to successful applicants thereof.

(a) 
Definition of Terms.
Installations.
Includes all electrical work of any nature performed on, in, or near consumers’ premises.
Journeyman Electrician.
One skilled and experienced in the actual physical labor involving electrical installations and who does, or who holds himself out as intending to actually do, electrical work under the employment and supervision of a master electrician. No more than two apprentice electricians shall work under the direct supervision of a journeyman or master electrician.
Master Electrician.
Includes those persons who, being highly skilled in methods and practices of installations, hold themselves out as intending to do installations and propose or do enter into contracts for such installations.
Person.
Construed to include the plural as well as singular and shall also include corporation and any other type of organization.

No person shall allow the use of his certificate of qualification license directly or indirectly by any other person for the purpose of obtaining a permit to do electrical installations. In addition to the penalty provided in Section 3.105, any person convicted of violation of this provision shall forfeit his certificate of qualification and license and it shall thereafter be void.

The decision of the board of electrical examiners shall be reviewed by the city council when within ten (10) days after receiving notice of rejection the dissatisfied applicant given notice in writing to the city manager that he desires a hearing before the city council; provided further, however, that in meritorious cases, the ten (10) day period may be waived by the city council.

No person, firm or corporation, using electric power as a consumer, shall begin any electrical installation or begin any work of installing, erecting or altering material, wiring fixtures or any other apparatus to be used for the utilization of electricity for light, heat and/or power in or on any building or premises in the city, without first securing a permit therefor from the office of the electrical inspector; provided, however, that no permit shall be required for minor work such as repairing flush or tumbler switches, replacing fuses, changing lamp sockets and receptacles; provided further that this section shall not apply to maintenance and repairs on the premises of a person, firm or corporation regularly employing a qualified maintenance electrician for that purpose.

Permit holders whose installations are ready for inspection shall allow the office of electrical inspector twenty-four (24) hours, Sundays and holidays excluded, before proceeding with the installation.

(a) 
Electrical Code Adopted.
For all buildings, structures, and electrical installations under the jurisdiction of the city, there is hereby adopted the NFPA 70, National Electrical Code, 2011 edition, published by the National Fire Protection Association, copies of which shall be maintained by the building official, with the following amendments in subsection (b) below.
(b) 
Amendments.
Article NEC250.118, Types of Equipment Grounding Conductors; change to read as follows:
The equipment grounding conductor run with or enclosing the circuit conductors shall be one or more or a combination of the following:
(1)
A copper, aluminum, or copper-clad aluminum conductor. This conductor shall be solid or stranded; insulated, covered, or bare; and in the form of a wire or a busbar of any shape.
(2)–(8)
Subsections are deleted.
(9)
The copper sheath of mineral-insulated, metal-sheathed cable.
(10)
Type MC cable that provides an effective ground-fault current path in accordance with one or more of the following:
 
a.
It contains an insulated or uninsulated equipment grounding conductor in compliance with 250.118(1).
 
b.
The combined metallic sheath and uninsulated equipment grounding/bonding conductor of interlocked metal tape-type MC cable that is listed and identified as an equipment grounding conductor.
 
c.
The combined metallic sheath and equipment grounding conductors of the smooth or corrugated tube-type MC cable that is listed and identified as an equipment grounding conductor.

(c) 
Service Entrances.
(1) 
General.
Service entrances shall comply with the NEC, applicable rules of the electric company, and this section.
(2) 
Enclosed Metering.
Should the addition or alteration of any building enclose the metering installation such that it will no longer be in an accessible outside location, the metering installation shall be relocated to a point outside the addition or alteration, maintaining strict conformance to the provisions of this chapter.
(3) 
Existing Inside Metering Locations.
Metering installations which are located inside a building shall be moved to an outside location at such time that changes, alterations or additions are made to the service entrance of the electrical installation. Metering installations moved outside shall conform to the provisions of this chapter.
(d) 
Encroachment on Public Way.
Neither feeder circuits nor branch circuits on any private electrical installation shall extend into, cross over or under any street, alley or public way which has been dedicated for public use. An electrical installation which is confined within a building or structure where a license and hold harmless agreement has been approved by the city and projects into, crosses over or under a dedicated street, alley or public way will not be affected by this regulation.
(e) 
Electric Signs and Outline Lighting.
(1) 
New Installation.
All electric signs and outline lighting shall be installed in compliance with all other applicable chapters of the municipal code and the provisions of this chapter.
(2) 
Existing Installation.
The electrical inspector, when he reasonably believes that any electric sign or outline lighting constitutes a hazard impairing safety of life or property, shall require that the sign or outline lighting installation be revised to meet the minimum standards established by this chapter and shall specify the time allowed for such revisions. If the required revisions are not completed within the time allotted, the electrical inspector shall order the electric sign or outline lighting disconnected from the power supply and the installation removed. Failure to comply with such a disconnect or removal order shall constitute a violation of this chapter.
(f) 
Mobile Homes and Travel Trailers.
Service entrance equipment for manufactured homes and recreational vehicles shall be considered as permanent electrical installations and shall meet the full requirements of this chapter.
(g) 
Electrical Fences.
(1) 
Generally.
All electrical fence installations shall require a permit prior to installation in accordance with this code. The materials and equipment used shall conform to the requirements of this code. All equipment and materials used for an electrical fence shall be part of a manufactured, UL listed, electrical fence assembly. The installation and use shall comply with the manufacturer’s listings and instructions.
(2) 
Size and Power Output.
Electric fences shall be designed and sized appropriately for the use as follows. Their power output shall not be designed or altered to inflict long-term damage to, maim, or kill humans:
(A) 
Domestic Use.
Electric fences surrounding all or a portion of a property whose primary use is residential shall be sized for the area encompassed by the fence, and only for containment of small domestic animals, both in accordance with the manufacturer’s recommendations. Such fences shall have only one (1) horizontal strand of charged wire.
(B) 
Agricultural Use.
Electric fences surrounding all or a portion of a property whose primary use is agricultural, shall be sized for the area encompassed by the fence, and for the size of the animals contained, both in accordance with the manufacturer’s recommendations.
(C) 
Commercial, Industrial, and Institutional Uses.
An electric fence designed for security purposes around all or a portion of a property whose primary use is commercial, governmental, industrial, or institutional shall be designed by a licensed engineer and installed in accordance with that design. Portions of such signs adjacent to a public way, or abutting other developed property, shall be adequately marked with signs to warn the public of the potential hazard.

Nothing herein shall be construed to prevent the issuance of permits to owners of dwellings for electrical repair work in such dwellings. Nothing herein shall be construed to prevent the issuance of permits to owners who erect a dwelling in which to live; provided, however, that no permit shall be issued under this provision until the owner submits an affidavit showing his ownership of the premises and his bona fide intention to live therein; provided further that in the event of erection, no person shall be issued a permit under the provisions of this subsection more frequently than once each two (2) calendar years.

(a) 
Any person, firm or corporation violating any of the terms or provisions of this article shall be guilty of a misdemeanor and upon conviction thereof shall be fined in accordance with the general penalty provision in Section 1.109 of this code.
(b) 
Each day that any person, firm or corporation shall continue to violate or fail to comply with a provision of this article shall be a separate offense.
(c) 
Any person, firm or corporation who employs any person who does not hold a license from the City of Friona, as required by this article, to do any electrical installation or construction, shall constitute a violation of this article.
(d) 
Upon conviction of the second violation of this article by a person, as that term is defined herein, the city council shall, if it deems advisable, hold a public hearing for the purpose of determining whether or not said person’s certificate or license should be revoked, and if revoked, it shall thereafter be void and vest no rights.
