Chapter 615 Vehicles and Traffic

"Trucks No U-Turn" signs shall be placed at the following locations:

One sign shall be placed at the intersection of Helen Street and Agnes Street.

One sign shall be placed at the Northbound ramp of the McKees Rocks Bridge heading towards Route 65.

A "No Left Turn" sign shall be placed at the following location:

§ 615-4 Closing of Herbst Alley to certain vehicles.

One sign shall be placed at the intersection of Harriet Street and O'Donovan Street.

Except as hereinafter provided, no vehicular traffic whatsoever shall be permitted over or upon any part of Herbst Alley except for private passenger automobiles, standard size taxicabs, motorcycles or bicycles, and trucks owned, leased or operated by or on behalf of any person, firm or corporation actually occupying any real estate bordering said alley, except that said trucks shall only be permitted upon said alley to the extent necessary to load, unload, or otherwise service the said real estate, any business situate thereon, or the occupants thereof.

Except as hereinafter provided, the maximum weight of any vehicle permitted on or over said alley shall not exceed 6,000 pounds. "Maximum gross weight" shall mean the actual weight of the vehicle, including all contents and occupants.

Nothing herein contained shall be deemed to restrict the travel of fire, police or military vehicles over or upon said alley, and nothing herein contained shall be deemed to restrict the travel of any vehicle over or upon said alley when the same is reasonably required to prevent, save, protect, or mitigate against the imminent, actual or impending loss of life, limb, or property. Vehicles of any public utility corporation may, if not in excess of the weight limitations contained in § 615-4B, travel over and upon said alley at any time to render any service necessary to any public utility line or dwelling or other structure serviced by the same. No such public utility vehicle in excess of said weight limitation shall, except as provided in the first sentence of this paragraph, travel over or upon said alley unless permission to do so is received from the Borough Secretary, which permission shall be granted only in cases of actual necessity and after reasonable precautions have been taken to protect against collapse of the aforesaid sewer.

Except as hereinbefore provided, no vehicle other than cycles or bicycles shall be permitted over or on said alley for the purpose of local delivery, service, or access, unless permission is secured in advance from the Borough Secretary, which permission shall only be granted in case of actual necessity and after reasonable precautions have been taken to protect against collapse of the aforesaid sewer. No garbage, refuse or rubbish collection shall take place in said alley.

Penalties and fines for violations of this section shall be as provided in the Motor Vehicle Code of the Commonwealth of Pennsylvania, 75 Pa.C.S.A. § 4902(g).

§ 615-5 Restrictions on commercial traffic.

From and after the effective date hereof, no motor vehicle licensed by the Commonwealth of Pennsylvania as a commercial vehicle, except for limousines and taxi cabs, may travel on any of the streets set forth in this section except as set forth below:

Said vehicles traveling on Robb Street shall not be permitted to proceed further north than Sproul Street;

Said vehicles traveling on Helen Street shall not be permitted to travel further north than Sproul Street;

Said vehicles traveling along Olivia Street shall not be permitted to travel further north than Sproul Street;

Said vehicles traveling on Martha Street shall not be permitted to travel further north than Rebecca Alley;

Said vehicles traveling north on Shingiss Street shall not be permitted to travel further north than Sproul Street;

(6)

Said vehicles traveling along Chambers Street shall not be permitted to travel further south than Sproul Street;

(7)

Said vehicles traveling along Ella Street shall not be permitted to travel further east than Munson Avenue;

(8)

Said vehicles traveling along Catherine Street shall not be permitted to travel further east than Munson Avenue.

It is the express intent of this section that the term "commercial vehicle" shall mean, in addition to the definition given thereto by the Commonwealth of Pennsylvania pursuant to the Motor Vehicle Code, any truck, pickup truck, trailer truck, tractor trailer, delivery truck, dump truck, or such other similar vehicle commonly denoted as a "truck."

It is expressly ordained and enacted that no commercial vehicle or "truck" as hereinafter defined shall be permitted to travel on any of the following streets or alleys:

There shall be prepared, in accordance with this section, a street map of the streets affected by this section with denotation thereon of the areas in which trucks and commercial vehicles are forbidden to travel.

Notwithstanding any of the other terms of this section, trucks and commercial vehicles may travel over and along streets heretofore forbidden to them for said travel for the sole purpose of making a local delivery. A "local delivery" is herein defined as a delivery to a structure for the purpose of delivering goods, wares, or merchandise to the owner or occupant of said structure for use in said structure. In no event, however, shall any vehicle weighing in excess of 10 tons, including the weight of any load thereon, be permitted to make any local delivery unless permission is first had and obtained from the office of the Borough Secretary of McKees Rocks. The Borough Secretary of the Borough of McKees Rocks is hereby empowered to grant permission to trucks and commercial vehicles in excess of 10 tons to make local deliveries to structures on streets hereinabove defined as forbidden to truck traffic upon a finding that:

The goods proposed to be delivered by said vehicle are in fact to be delivered to a structure situate on a street in which or along which truck traffic is forbidden;

The goods proposed to be delivered as actually intended for delivery to the owner of such structure or an occupant thereof for use in said structure;

That the traversing of said street by said vehicle for the purpose of making said local delivery will not cause inordinate damage to the surface or subsurface of said street;

§ 615-9 Parking prohibited at all times.

That the traversing of said street by said vehicle is necessary to effectuate the delivery of the goods proposed to be delivered.

Notwithstanding any other term or condition of this section, any vehicle may pass over or along any street or portion thereon hereinabove being defined as forbidden to truck traffic upon obtaining a permit to do so. Permits for said purpose may be obtained from the office of the Borough Secretary upon a showing that said vehicle or vehicles must, of necessity, pass over said street or streets to arrive at their intended destinations, and that permits shall only be granted by the Borough Secretary after arranging for a police escort for said vehicle and receipt of the required fee from the owner or operator of the vehicle desiring to traverse over said street or streets. The required fee shall be the sum of $85.

The proper officers, officials and employees of the Borough are ordered and instructed to erect and construct the necessary traffic posting signs to indicate to the traveling public the prohibitions contained in this section and the proper officers of the Borough are hereby authorized and empowered to make the necessary expenditures to purchase said traffic signs and to see to the erecting of said signs.

Any person, firm, or corporation found guilty of violating any portion of this section shall be guilty of a summary offense and, upon conviction thereof, shall pay a fine of at least $250, but no more than $600. The fines and penalties hereinabove set forth shall be in addition to and not in limitation of those imposed by any other ordinance of the Borough, or by the Motor Vehicle Code of the Commonwealth of Pennsylvania. Upon failure of any person convicted under the terms of this section to pay the fine imposed thereby, the person so convicted shall be incarcerated in the Allegheny County Jail for a period not to exceed 20 days. In addition to any set forth herein, any person convicted of violating any portion of this section shall be required to pay all costs of prosecution.

§ 615-6 Vehicle weight limits.

From and after the effective date of this section, it shall be unlawful to operate or cause to be operated on any Borough street, except those noted hereafter, any vehicle having a gross vehicle weight, including chassis, body and load, more than 10,000 pounds, except for local deliveries.

Exceptions. The following Borough streets shall not be included as weight-restricted streets:

§ 615-7 Violations and penalties.

Unless another penalty is expressly provided, any person who violates a provision of this article shall, upon conviction, be subject to the appropriate penalties set forth in the Pennsylvania Vehicle Code (75 Pa.C.S.A. § 101 et seq.) for each provision so violated.

Article II Parking Regulations

§ 615-8 Parking authorized.

Parking is hereby authorized on the following streets:

§ 615-10 Time limit parking.

No person shall park a vehicle or allow the same to remain parked upon any of the streets or parts of streets described in this section, between the hours specified, for longer than the time indicated :

§ 615-11 Parking, stopping or standing.

Except when necessary to avoid conflict with other traffic or to protect the safety of any person or vehicle, or in compliance with law or the directions of a police officer or official traffic-control device, no person shall:

Stop, stand or park a vehicle:

On the roadway side of any vehicle stopped or parked at the edge or curb of a street, except that:

A pedalcycle may be parked as provided in 75 Pa.C.S.A. § 3509(b)(2).

Standing or parking for the purpose of loading or unloading persons or property may be authorized by ordinance, but the ordinance shall not authorize standing or parking on state-designated highways except during off-peak traffic-flow hours as determined by Pennsylvania Department of Transportation regulations.

On a sidewalk except that a pedalcycle may be parked as provided in 75 Pa.C.S.A. § 3509(b)(2).

(c)

Within an intersection.

(d)

On a crosswalk.

(e)

Between a safety zone and the adjacent curb within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by official traffic-control devices.

(f)

Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic.

(g)

Upon any bridge or other elevated structure upon a highway or within a highway tunnel.

(h)

Upon any railroad tracks.

(i)

In the area between roadways of a divided highway, including crossovers.

(j)

At any place where official signs prohibit stopping.

Stand or park a vehicle:

In front of a public or private driveway.

Within 15 feet of a fire hydrant.

(c)

Within 20 feet of a crosswalk at an intersection.

(d)

Within 30 feet upon the approach to any flashing signal, stop sign, yield sign or traffic-control signal located at the site of a roadway.

(e)

Within 20 feet of the driveway entrance to any fire station or, when properly sign posted, on the side of a street opposite the entrance to any fire station within 75 feet of the entrance.

(f)

Where the vehicle would prevent the free movement of a streetcar.

(g)

On a limited access highway unless authorized by official traffic control devices.

(h)

At any place where official signs prohibit standing.

Park a vehicle:

Within 50 feet of the nearest rail of a railroad crossing.

At any place where official signs prohibit parking.

Unattended vehicle on private property:

No person shall park or leave unattended a vehicle on private property without the consent of the owner or other person in control or possession of the property except in the case of emergency or disablement of the vehicle, in which case the operator shall arrange for the removal of the vehicle as soon as possible.

§ 615-13 Overnight parking prohibited for certain vehicles.

The provisions of this subsection shall not apply to private parking lots unless such lots are posted to notify the public of any parking restrictions and the operator of the vehicle violates such posted restrictions. For the purposes of this section, "private parking lot" means a parking lot open to the public or used for parking without charge; or a parking lot used for parking with charge. The Borough shall define by regulation what constitutes adequate posting for public notice.

The Borough, on any local highway within their boundaries, may, by erection of official traffic control devices, prohibit, limit or restrict stopping, standing or parking of vehicles on any highway where stopping, standing or parking would constitute a safety hazard or where the stopping, standing or parking of vehicles would unduly interfere with the free movement of traffic.

Any person violating any provision of this section is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of not more than $50.

§ 615-12 Loading zones.

The following described locations are hereby designated as loading zones:

Except where allowed subject to a permit obtained from the Borough, the parking of nonpassenger commercial vehicles on any street, highway, alley or public thoroughfare in the Borough of McKees Rocks between the hours of 6:00 p.m. and 7:00 a.m. is, except as expressly set forth hereinafter, prohibited and forbidden.

The term "nonpassenger commercial vehicle" means any motor vehicle required by the Commonwealth of Pennsylvania to be registered with vehicle license plates other than motorcycle or passenger car license plates.

Notwithstanding the foregoing provisions of this section, vehicles commonly known as "pickup trucks" may be parked on the streets, highways, alleys or public thoroughfares in the Borough of McKees Rocks if said "pickup truck" is parked for use by the owner of a residence in the Borough of McKees Rocks. For the purposes of this section only, the term "person" means a natural person and not a corporation.

Notwithstanding any other provision hereof, this section shall not apply to nonpassenger commercial vehicles parked on streets, highways, alleys or public thoroughfares in the Borough of McKees Rocks when said vehicles are being used to receive or deliver goods, wares and/or merchandise to or from buildings situated within 100 feet of the place where said vehicle or vehicles are parked, and so long as said vehicle or vehicles are not parked for a period in excess of 60 minutes.

Notwithstanding any other provision hereof, the parking of a motor home or a trailer having a registered gross weight of less than 3,000 pounds shall not be permitted on residential streets within the Borough, but for a 30 minutes for the purposes of loading. In addition, said vehicles in violation shall be subject to towing.

Any individual, firm, person, or corporation violating the provisions of this section shall, upon summary conviction thereof before any Magisterial District Judge having jurisdiction thereof, be subject to a fine of not less than $100 nor more than $300 per day.

Any motor vehicle which is parked in violation of this section and which presents a hazard to the safety of persons and/or property may be towed to the nearest public parking place at the expense of the owner or operator thereof, and all such towing and storing charges as may be incurred by the Borough of McKees Rocks shall be borne by said operator or owner.

Any ordinances, including without limitation McKees Rocks Borough Ordinance Nos. 1517, 1404, 1055 or parts of any ordinances inconsistent herewith are hereby repealed.

§ 615-14 Parking permits.

Definitions. For the purposes of this section, the following terms shall have the meanings as set forth:

CERTIFIED RESIDENT

A property owner having title to real property or a renter who has a valid apartment lease.

HOUSEHOLD

All persons occupying a dwelling unit.

LEASE

A person pays rent or other remuneration for use of a parcel of real property as his residence or place of business.

MOTOR VEHICLE

Includes an automobile, truck, motorcycle or other motor-driven form of transportation.

PARKING PERMIT OFFICER

An ordinance officer or a police officer employed by the Borough of McKees Rocks.

PERMIT PARKING AREA

An area designated by ordinance of Borough Council in which only motor vehicles displaying a parking permit may park on public streets during such times as Council shall fix by ordinance or by resolution.

RESIDENT VEHICLE

A motor vehicle having a gross vehicle weight of less than 6,000 pounds which is registered or for which an application for registration has been made to the Pennsylvania Department of Motor Vehicles.

RESIDENTIAL PARKING PERMIT

A permit issued to persons pursuant to § 615-14C, as amended.

Permit parking area. No motor vehicle shall park for more than one hour on any public street within a permit parking area during restricted times without displaying a residential parking permit.

Issuance of parking permits.

Parking permits shall be issued by the Borough Secretary. No more than one parking permit shall be issued to each motor vehicle for which application is made.

Parking permits may be issued to motor vehicles only upon application of the following persons:

A certified resident of said residential parking permit area who has a motor vehicle registered in his name or a motor vehicle under his control.

A person who owns or leases commercial property and actively engages in a business activity within a residential parking permit area. However, not more than one parking permit may be issued for each business establishment where a motor vehicle is registered to or under the control of such a person.

Proof of residency or ownership and motor vehicle ownership and control of use in the residential parking area shall be demonstrated in a manner determined by the Borough Manager.

Posting signs indicating restrictions. The Borough Manager shall cause appropriate signs to be erected in the area, indicating prominently thereon, the time limitations, the period of day when permits are required, and the conditions when parking is restricted to vehicles with residential parking permits.

Display of parking permits. Permits on motor vehicles shall be displayed in a manner to be determined by the Borough Manager.

No reserved parking. A residential parking permit shall not guarantee or reserve the holder thereof a designated parking space within the designated residential parking area.

Parking permit term and renewal. Each parking permit issued by the Borough Manager shall be valid for one year from the date of issuance. Permits may be renewed annually upon reapplication in the manner required by the Borough Manager.

Parking permit fees. The annual fee for the residential parking permit shall be set by resolution of the Borough Council for each vehicle.

Penalty.

Violation of any provision of this section, except § 615-14J(1) and (3), shall subject the violator, upon conviction, to a fine of $50.

Any person violating § 615-14J(1) shall, upon conviction, be fined an amount not in excess of $600.

Permit violations.

No person shall falsely represent himself as eligible for a parking permit or furnish false information on an application for a parking permit.

No person shall hold a valid parking permit issued pursuant hereto or permit the use or display of such permit on a motor vehicle other than that for which the permit is issued.

No person shall produce, copy or otherwise bring into existence a facsimile or counterfeit parking permit or permits without written authorization from the Borough Manager, and no person shall use or display the facsimile or counterfeit parking permit in order to evade time limitations on parking applicable in said residential parking permit area.

Permit revocation. The Borough Manager is authorized to revoke the residential parking permit of any person found to be in violation of this section and, upon written notification thereof, the person shall surrender such permit to the Borough Manager.

Repealer. Ordinance No. 1460 is amended to the extent that it is inconsistent repealed with this section. Ordinance Nos. 1620, 1598, and 1599 are repealed absolutely. Any other ordinance or parts of ordinances conflicting with the provisions of this section are hereby repealed to the extent of such conflict.

Existing violations. Section 615-14L shall not affect or be defense to violations occurring before the effective date of this section.

Effective date. This section and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect 30 days after the date of its final passage and adoption.

§ 615-15 Municipal park.

From and after the date hereof, the public parking area adjacent to and serving that certain municipal park situate in the Second Ward of the Borough of McKees Rocks, commonly known as "Rangers Field," shall be used and made available exclusively for those persons patronizing and using said municipal park facilities.

From and after the date hereof, parking in the aforesaid parking area shall be restricted only to the vehicles being used by those individuals then and there patronizing said public park facility. The proper officers and employees of the Borough of McKees Rocks are hereby empowered to erect necessary signs and warnings to advise the public at large of the restrictions upon parking at the aforesaid parking area.[1]

§ 615-16 Parking lots.

Regulating parking in the First Ward.

The Secretary of the Borough of McKees Rocks is hereby empowered to lease space in the aforesaid parking lot for the purpose of parking of motor vehicles, which leases may be in excess of one day, at the rate of $10 per month. Leases for fractional periods of a month shall be for a sum obtained by multiplying $10 by a fraction, the numerator of which is the number of days in said month and the denominator of which is 30.

The Secretary shall take care to see that sufficient parking spaces are available to the motoring public on a daily basis, and shall limit the number of leased parking spaces accordingly.

Areas of the aforesaid parking lot shall be reserved for lease parking and the same shall be so indicated by signs or notices posted thereat. It shall be a violation of this section for anyone not a lessee of a parking space in said lot to park a motor vehicle in the area reserved for leased parking.

It shall be the duty of the police of the Borough to make reports to the Mayor designating the location where any violation of this section occurs, the license number of the vehicle involved in such violation, the time when such vehicle was parked in violation of any of the provisions of this section. The police officer making such report shall also attach to every such vehicle a notice that such vehicle was parked in violation of this section, which notice shall contain instructions to such owner or operator to report to the office of the Mayor for payment of the sums hereinafter set forth, which sums are hereby declared to be the penalties for parking in violation of the lawful parking periods established by this section. Any owner or operator, having received a notice of the parking violation, shall within seven days of the time when such notice was given or attached to the vehicle, pay to the Mayor as a penalty, the sum of $5 or shall, upon conviction thereof, before any Magisterial District Judge having jurisdiction thereof, be sentenced to pay a fine of not less than $5 nor more than $10, and costs of prosecution and, in default of payment of such fine and costs, to imprisonment, in the County Jail for not more than 10 days; provided, however, that payment of the sum of $5 to the Mayor, within the time limits and under the circumstances provided for by § 615-16A(4), shall save from prosecution any person making such payment.

Regulating parking in McKees Rocks.

Between the hours of 4:00 a.m. and 6:00 a.m., daily, all parking in the McKees Rocks Borough public parking lot bounded by Furnace Street and Chartiers Creek in said Borough be and the same hereby is prohibited, except that persons purchasing monthly parking permits and persons residing in any real estate bordering said parking lot shall be permitted to park in said parking lot 24 hours per day, daily.

During all other hours of the day, except the hours of 4:00 a.m. to 6:00 a.m., parking in the McKees Rocks Borough public parking lot as described aforesaid shall be in accordance with the rules, regulations and ordinances heretofore existing.

The proper officers of the Borough of McKees Rocks, including elected officials, Street Department Commissioner and Chief of Police are hereby authorized to do all acts, matters and things reasonably necessary to advise the public of the fact that parking is prohibited in said parking lot between 4:00 a.m. and 6:00 a.m. daily.
