[Adopted 12-15-2008 by Ord. No. 2008-13 (Ch. 2.93, Secs. 2.93.10 through 2.93.17, of the 1997 Code)]
This article is adopted for the purpose of promoting a safe and orderly parking of motor vehicles within areas designated and established by the Borough as commuter parking. The Borough shall set aside five parking spaces in the Hamilton Street Parking Lot to be used by commuters commencing January 1, 2009. The Borough reserves the right to increase or decrease this number in the future.

A. 
Parking in said spaces shall be designated by permit only, which shall be evidenced by a tag issued to an applicant by the Borough.
B. 
Such parking areas shall be marked by signs indicating that parking will be by permit only seven days per week and all vehicles parked in designated spaces must display a valid, Borough-issued tag.
C. 
No vehicle shall be parked in any such parking space unless it displays on the interior rear view mirror a current and valid tag so issued by the Borough of Englishtown as herein provided.
D. 
No vehicle shall be parked in any such parking area displaying a parking tag that is reported lost, stolen, mislaid or undelivered or whose identification number is obscured or has been removed.
E. 
All vehicles shall be parked within a single designated parking space as indicated by marked lines on the surface of the parking area or unless otherwise instructed by a police officer or other attendant in charge.
F. 
Vehicles, because of size, which occupy more than one parking or which extend into a traffic aisle shall be excluded from commuter parking areas.

A. 
The required parking permits shall be issued by the office of the Borough Clerk. Persons wishing to purchase said permits must complete the application form supplied by the Borough Clerk and must submit copies of a valid New Jersey driver's license and New Jersey vehicle registration certificate. Permits may only be purchased by persons residing in the Borough of Englishtown who hold a valid New Jersey driver's license and whose driving privileges have not been suspended. The address on the applicant's driver's license will be used to verify the applicant's residence. The Borough Clerk shall keep a record of all permits issued and said record shall include the completed application form, the permit number, the driver's license number of the applicant and the vehicle registration number of each vehicle which shall utilize the permit.
B. 
Applications for the issuance of parking permits must be submitted by November 1 for the succeeding year. All permits will be issued on a first-come, first-served basis.
C. 
Permits will be valid for a period of one year. Thus, permits issued in November of any given year will become effective January 1 of the succeeding year and expire on December 31 of the succeeding year.
D. 
The fee for the parking permits shall be $120 per annum. Said fee is nonrefundable and must be paid in full at the time of application.
E. 
Only one parking permit per household may be purchased, but said permit may be transferred between vehicles registered to the same household or family.
F. 
All permits shall bear a number assigned by the Borough Clerk and shall bear the expiration date of the permit.
Any person parking a motor vehicle with such tag affixed thereto shall be presumed to have properly applied for and received permission to park said motor vehicle in the Borough's designated commuter parking spaces.
No person shall permit a disabled vehicle to remain in any commuter parking area for more than 36 hours without the express permission of the police.[1]

A. 
Handicapped parking standards. Accessible spaces reserved for use by individuals with disabilities shall be identified by a sign installed five feet to seven feet above the ground, bearing the international symbol of accessibility and shall also include a penalty notification specifying the mandatory fines for offense. Signs identifying van parking spaces shall contain the designation "van accessible." The parking spaces and access aisles shall be painted blue and shall be at least 96 inches (eight feet) wide for accessible car parking spaces, at least 132 inches (11 feet) wide for van-accessible parking and a minimum of 60 inches (five feet) wide for access aisles for both accessible car and van spaces.
B. 
Handicapped parking spaces. The total number of parking spaces required shall be in accordance with the revised and updated ADA standards of accessible design:
(1) 
One to 25 spaces: at least one in each lot.
(2) 
Required number of van accessible spaces if constructed or altered prior to March 5, 2012: 1:8.
(3) 
Required number of van accessible spaces if constructed or altered on or after March 15, 2012: 1:6.
(4) 
Twenty-six to 50 spaces: two in each lot;
(5) 
Fifty-one to 75 spaces: three in each lot;
(6) 
Seventy-six to 100 spaces: four in each lot;
(7) 
One hundred one to 150 spaces: five in each lot;
(8) 
One hundred fifty-one to 200 spaces: six in each lot;
(9) 
Two hundred one to 300 spaces: seven in each lot;
(10) 
Three hundred one to 400 spaces: eight in each lot;
(11) 
Four hundred one to 500 spaces: nine in each lot;
(12) 
Five hundred one to 1,000 spaces: 2% of total spaces, one in every eight for van-accessible spaces.

In addition to the foregoing, the Borough shall set aside 10 parking spaces in the Hamilton Street parking lot as maximum two-hour parking between the hours of 7:00 a.m. through 7:00 p.m. daily, seven days per week.
A. 
The owner of any vehicle parked in violation of any provisions of this article other than § 455-16 shall be subject to a fine of $100.
B. 
The owner of any vehicle parked in violation of § 455-16 of this article shall be subject to a fine of not less than $500 nor more than $1,000, as set forth in N.J.S.A. 39:4-207.9c.
C. 
Any vehicle parked in any such parking area in violation of this article may be removed from the parking area on order of any police officer, and the owner thereof shall pay the reasonable cost of such removal and storage which may result from such removal before being allowed to regain possession of the vehicle, and such costs of removal and storage shall be in addition to any penalty and/or fine hereinbefore provided.
