Whenever any words and phrases are used in this article, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.
All former traffic ordinances of the Borough of Englishtown are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this article.
If any part or parts of this article are held to be invalid for any reason, such decision shall not affect the validity of the remaining portions of this article.

Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this article or any supplement thereto shall be liable to a penalty of not less than $50 or imprisonment for a term not exceeding 15 days, or both.
The effectiveness of this article is contingent on signs being erected by law.

The provisions of this article imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

B.
In accordance with the provisions of this § 600-7, no motor vehicle over five tons' gross weight or any passenger vehicle with an occupancy load in excess of 16 passengers shall be parked on the streets of the Borough of Englishtown at any time. In addition, no boat, landscape, construction, lowboy, pop-up, tagalong, moving, recreational vehicle or equipment trailers of any type shall be permitted to be parked on any street in the Borough.
C.
This shall not apply to any vehicle actively making a pickup or delivery.

A.
Trucks over four tons' gross weight are hereby excluded from local municipal roads located within the Borough of Englishtown with the exception of the designated truck route (see § 600-11).
B.
This section shall not prevent vehicles over four tons from making pickups or deliveries to residences, maintenance, construction, road repair, garbage collection, emergency vehicles or any other necessary services.

Trucks over four tons making pickups or deliveries at Englishtown Industrial Park (Harrison Avenue) shall turn from Main Street on to Pine Street, make a right turn on to Harrison Avenue and a left turn into the Englishtown Industrial Park. Trucks shall exit using the same route.

A.
Whenever snow has fallen with an accumulation of two inches or greater and is such that it covers the street or highway, no vehicle shall be parked on either side of any of the streets or parts thereof described below:

The above parking prohibitions shall remain in place after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.

A.
Upon the declaration of an emergency, there shall be no parking upon streets or parts of streets where temporary emergency no-parking signs are displayed. The officer in charge or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of said emergency no-parking signs when weather conditions, accidents, fires or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic.
B.
Notification that the emergency no-parking signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.

Any unoccupied vehicle parked or standing in violation of this article shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

Regulatory and warning signs shall be erected and maintained to affect the designated speed limits as authorized by the Department of Transportation.

The traffic signal installation shall be in accordance with the provisions of an Act Concerning Motor Vehicles and Traffic Regulations, Subtitle 1 of Title 39 of the Revised Statutes, shall conform to the design and shall be maintained in operation as authorized by the Department of Transportation of the State of New Jersey.[1]

Note: No traffic signal control ordinance will be considered for approval by the Commissioner of Transportation unless the installation has been duly authorized and inspected by the Department of Transportation. A.
Parking regulations (i.e., one-hour parking) will be suspended for special events on all Englishtown roadways at the discretion of the Mayor, Council, officer in charge or, in his absence, the ranking police officer.
B.
When the parking regulations are suspended, signs shall be posted by the Englishtown Police Department in reasonable locations to provide notice to all motorists of the special event. These signs shall be placed at the discretion of the Mayor, Council, officer in charge or, in his absence, the ranking police officer.

When signs are erected indicating such, it shall be unlawful for any person to block a driveway within the Borough of Englishtown.

It shall be prohibited to park, stand or stop within a properly marked loading zone unless the vehicle is engaged in making deliveries or servicing buildings in the area.
