As used in this article, the following terms shall have the meanings indicated:
BEACH
Any sandy and nearly level area between the landward edge of low tide and the seaward edge of upland marked by dunes or beach grass.
BOAT
Any vessel or watercraft propelled by oars, sails. (Paddleboards will not be considered boats for this purpose of Article V.)
FORESHORE
The area between high tide and low tide.
In any beach or foreshore area owned and subject to municipal regulation, no person shall store or maintain any boat for a period in excess of one day except as provided herein. This article shall not apply to any boat owner storing a boat on the beach or foreshore contiguous to and seaward of that owner's residence, and any such storage shall be exempt from this article.
The Village Clerk is authorized to issue permits for the storage of small boats not longer than 12 feet at any beach or foreshore area within the Village, provided that:
A. 
The applicant and boat owner are Village residents;
B. 
A permit application form is completed to the satisfaction of the Village Clerk;
C. 
A fee set by resolution of the Board of Trustees from time to time is paid in full;
D. 
The applicant and boat owner agree to affix and maintain a registration sticker on the bow of the boat or other conspicuous location;
E. 
The boat shall be maintained at a location specifically designated on the application and approved by the Village Clerk and not elsewhere;
F. 
The boat shall be removed by the applicant no later than October 31 of the year during which the permit was issued;
G. 
The applicant and boat owner shall each execute an agreement as part of the application, holding the Village harmless by reason of the storage of the boat;
H. 
A maximum of one permit will be issued to any household, for a seasonal total of 35 boats, on a first-come-first-served basis. (A prior year permit does not guarantee that an applicant will be issued a permit in the current year.)
I. 
Any permit is not assignable; and
J. 
No permit shall be issued prior to May 1 of any year.
Any permit issued under this Article V and any use of the beach or foreshore area to store a boat shall be revoked by the Board of Trustees in the event the permit holder violates any provision of this Article V or the boat is stored in such a manner as to adversely affect the safety and welfare of other persons using the beach or foreshore area.
A. 
Any boat shall be removed no later than October 31.
B. 
Any boat not timely removed shall be deemed abandoned. Any abandoned boat shall be disposed of at the sole election of the Board of Trustees by sale, either at an advertised auction or otherwise, or by destruction (date of destruction to be advertised); and the owner of each and any shall be liable for all expenses incurred by the Village.
C. 
Any owner may redeem his or her boat prior to sale or other disposition as provided herein upon payment of all actual expenses incurred by the Village and the sum of $250.
