"A Local Law to Add a New Article XI, Grievance Day, to Chapter 127, Taxation, of the Code of the Town of New Paltz, Changing the Date Established for Grievance Day for Real Property Assessment Review."
A. 
This article is enacted pursuant to New York Real Property Tax Law § 512, which enables a town to enact a local law to change grievance day for real property assessment review from the fourth Tuesday of May to the first Thursday after the fourth Tuesday of May.
B. 
This article supersedes, and is in place of, the date for the hearing of complaints set forth in Subdivision 1 of § 512 of the Real Property Tax Law.
The Town of New Paltz in the County of Ulster employs an Assessor who is at the same time employed by another assessing unit. Pursuant to the authority granted by § 512 (1-a) of the Real Property Tax Law, the Town of New Paltz desires to establish a date for the meeting of the Board of Assessment Review other than that provided in Subdivision 1 of § 512 of the Real Property Tax Law.
The Town of New Paltz hereby adopts as and for its grievance day the first Thursday after the fourth Tuesday of May and so many days thereafter as the Board of Assessment Review shall deem necessary to meet and to hear complaints in relation to assessments pursuant to § 512 of the New York State Real Property Tax Law.
If any clause, sentence, paragraph, subdivision, section, or part of this article or the application thereof to any person, individual, corporation, firm, partnership, entity or circumstance shall be adjudged by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, effect or invalidate the remainder thereof but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section or part of this law, or in its application to the person, individual, corporation, firm, partnership, entity or circumstance, directly involved in the controversy in which such order or judgment shall be rendered.
If any part or provision of this article or the application thereof to any person or circumstance be adjudicated invalid by a court of competent jurisdiction, such judgment shall be confined in its operation to the part or provision or application directly involved in the controversy in which such judgment shall have been rendered and shall not affect or impair the validity of the remainder of this article or the application thereof to other persons or circumstances, and the Town Board of the Town of New Paltz hereby declares that it would have passed this article or the remainder thereof had such invalid application or invalid provision been apparent.
All ordinances, local laws and parts thereof that are inconsistent with this article are hereby repealed.
This article shall take effect immediately upon the filing in the office of the New York State Secretary of State.
