The purpose and intent of this article is to secure the general health, safety, and welfare of the residents of the city by:
(1) 
Reaffirming the existing city fire department and explicitly establishing the fire department and outlining both its authority and jurisdiction;
(2) 
Reaffirming and explicitly establishing the position of fire chief to oversee and manage the city fire department; and
(3) 
Outlining the duties and responsibilities of both the fire chief and firefighters.

The City of Aubrey Fire Department ("department" or "city fire department" is hereby reaffirmed and established as the fire department of the city, at the head of which shall be the fire chief. The city fire department shall be composed of the fire chief and other firefighter/paramedics and employees as the city council may approve. The jurisdiction of the city fire department shall be within the corporate limits of the city and shall extend to all of that area lying within the limits of fire service area established and approved by the city. Additionally, the city fire department is authorized to provide fire and emergency medical services to other jurisdictions through interlocal agreements and mutual aid. Any requirement of this division may be satisfied by another department or jurisdiction if the city has an interlocal cooperation agreement or mutual aid agreement with another political subdivision to perform the requirements or if the city is the recipient of mutual aid. The fire department shall perform other duties as directed by ordinance or by the city manager.

No person will be appointed as a city firefighter/paramedic who has not complied with the basic requirements established by the state for firefighter/paramedics and by the city acting through the fire chief under the supervision of the city manager.

(a) 
The city fire department shall consist of the fire chief and such members as the city council may provide.
(b) 
The fire chief shall be appointed by the city manager after consultation with the city council.
(c) 
The fire chief shall carry out the functions of the city fire department relating to public safety and treatment of the sick and injured; organize the city fire department in conformity with the laws of the state and ordinances of the city; and shall promulgate policies, procedures, rules, directives, and orders for the administration of the department, including but not limited to discipline within the department.

All personnel of the department shall be bound by the most current directives, orders, rules, regulations, and procedures for the operation of the city fire department as may be promulgated or as hereinafter amended by the fire chief, and failure to abide thereby shall subject the violating personnel to such disciplinary action as may be determined by the fire chief within the limits of state law, city ordinances and adopted policies and procedures of the city and the department.
