There is hereby adopted by the City of Excelsior Springs the
2018 Edition of the International Fire Code regulating and governing
the safeguard of life and property from fire and explosion hazards
arising from the storage, handling and use of hazardous substances,
materials and devices and from conditions hazardous to life or property
in the occupancy of building and premises in the City of Excelsior
Springs; providing for the issuance of permits for hazardous uses
or operations. One (1) copy has been and is now filed in the office
of the City Clerk, and the same is hereby adopted and incorporated
as fully as if set out at length herein, and the provisions thereof
shall be controlling within the limits of the City.

A. When
the Excelsior Springs Fire Department issues a construction or operational
permit the 2018 International Fire Code Section 106, Fees, applies.
A permit shall not be issued until the fees have been paid. A fee
for each permit shall be paid as required, in accordance with the
following fee schedule:
Open burning permit inside City limits: See Schedule of Fees,
Title I, Appendix A.
Operational permit: See Schedule of Fees, Title I, Appendix

Construction permit: See Schedule of Fees, Title I, Appendix
A.
Outdoor fireworks display: See Schedule of Fees, Title I, Appendix

Outdoor fireworks display site clean-up deposit: See Schedule

B. Sites
clean-up area is at the discretion of the property owner. Deposits
will be refunded when the property owner or Fire Department are satisfied.
C. For
property owned by the City of Excelsior Springs, the clean-up area
will be at the discretion of the Excelsior Springs Parks and Recreation
Department, the area is dependent on fall out and wind conditions.
Sites must be cleaned and all equipment removed by 10:00 A.M. the
following day. Deposits will be refunded when the representative of
the Parks and Recreation Department is satisfied.

hereof as if fully set out in this Article.

A. The
following Sections of the International Fire Code, 2018 Edition, are
hereby revised:
1.
101.1 Title. These regulations shall be known as
"the Fire Code of the City of Excelsior Springs, Missouri," hereinafter
referred to as "this code."
2.
110.4 Violation penalties. Persons who shall violate
a provision of this code or shall fail to comply with any of the requirements
thereof or who shall erect, install, alter, repair or do work in violation
of the approved construction documents or directive of the fire code
official, or of a permit or certificate used under provisions of this
code, shall be guilty of a misdemeanor, punishable by a fine of not
more than two hundred fifty dollars ($250.00) or by imprisonment not
exceeding ninety (90) days, or both such fine and imprisonment. Each
day that a violation continues after due notice has been served shall
be deemed a separate offense.

112.4 Failure to comply. Any person who shall continue
any work after having been served with a stop-work order, except such
work as that person is directed to perform to remove a violation or
unsafe condition, shall be liable to a fine of not less than one hundred
dollars ($100.00) or more than two hundred fifty dollars ($250.00).

5704.2.9.6.1 Locations where above-ground tanks are prohibited. Storage of Class I and Class II liquids in above-ground tanks outside
of buildings are prohibited in heavily populated and/or congested
commercial areas. A permit for an above-ground tank of up to one thousand
(1,000) gallons may be approved by the fire code official in non-congested
commercial and/or industrial areas.
Exception: Above-ground tank no larger than fifteen
thousand (15,000) gallons may be approved by the fire code official
in "M-2" zoning districts. Provided they meet the requirements of
the 2018 International Fire Code Chapter 57, Flammable and Combustible
Liquids.

5706.2.4.4 Locations where above-ground tanks are prohibited. Storage of Class I and Class II liquids in above-ground tanks outside
of buildings are prohibited in heavily populated and/or congested
commercial areas. A permit for an above-ground tank of up to one thousand
(1,000) gallons may be approved by the fire code official in non-congested
commercial and/or industrial areas.

5806.2 Limitations. Storage of flammable cryogenic
fluids in stationary containers outside of buildings is prohibited
within heavily populated and/or congested commercial areas. A permit
for an approved tank of up to one thousand (1,000) gallons may be
approved by the fire code official in non-congested commercial and/or
industrial areas.

6104.2 Maximum capacity within established limits. The storage of liquefied petroleum gas is restricted for the protection
of heavily populated or congested areas. Tanks not to exceed the water
capacity of two thousand (2,000) gallons may be approved by the fire
code official in the following zoning districts: A, C3, M1 and M2.
Exception: In particular installations, this capacity
limit shall be determined by the fire code official, after consideration
of special features such as topographical conditions, nature of occupancy,
proximity to buildings, capacity of proposed LP-gas containers, degree
of fire protection to be provided and capabilities of the local fire
department.
8.
Section 307 Open Burning, Recreational Fires and Portable
Outdoor Fireplaces. Delete this section.
