The purpose of this article is to provide for the licensing and identification of dogs.
All dogs in the Village of Briarcliff Manor four months of age or older, unless otherwise exempted herein, must be licensed. The owner of each dog required to be licensed shall obtain, complete and return to the Village Clerk a dog license application together with the license application fee, any applicable license surcharges and such additional fees as may be established by the Village of Briarcliff Manor. Each license application shall be accompanied by proof that the dog has been vaccinated against rabies or a statement from a licensed veterinarian that such vaccination would endanger the dog's life, in which case vaccination shall not be required. Each license issued shall be valid for a period of one year and shall not be transferrable.
A. 
The license fee for a spayed or neutered dog shall be set by the Board of Trustees in the Master Fee Schedule, as the same may be amended from time to time by resolution.
B. 
The license fee for an unspayed or unneutered dog shall be set by Village Board of Trustees in the Master Fee Schedule, as the same may be amended from time to time by resolution.
C. 
In addition to the license fees established herein, each applicant for a dog license shall pay a surcharge set by the Village Board of Trustees in the Master Fee Schedule, as the same may be amended from time to time, pursuant to § 110, Subdivision 3, of the New York State Agriculture and Markets Law, to be remitted by the Village to New York State for animal population control efforts.
D. 
In addition to the license fees imposed herein, each applicant for a dog license shall pay an additional surcharge set by the Village Board of Trustees in the Master Fee Schedule, as the same may be amended from time to time, pursuant to New York State Agriculture and Markets Law § 110, Subdivision 4, which shall be retained by the Village of Briarcliff Manor and used to defray the cost of an enumeration of dogs living within the Village of Briarcliff Manor when the Board of Trustees determines the need for a dog enumeration, and the cost of providing replacement identification tags.
E. 
The Village of Briarcliff Manor will not be issuing purebred or kennel licenses. All dogs will be licensed individually as per the fee system stated above.
F. 
Excepted from payment of the license fee are applications submitted for a dog license for any guide, hearing, service, war, working search, detection, police and therapy dogs.
G. 
The Village of Briarcliff Manor does not allow the licensing of dogs by a shelter. The shelter, at the time of adoption, must notify the adoptive owners of their responsibility to license any dog who will be living within the Village of Briarcliff Manor with the Village Clerk within 30 days of adoption. The shelter must provide the Village of Briarcliff Manor with a list of adoptive owners monthly.
H. 
Dogs owned by one or more senior residents 65 years or older shall be subject to discounted licensing fees set by the Village Board of Trustees in the Master Fee Schedule as the same may be amended from time to time.
