Any member of the city council, including the mayor, may request that an item concerning city business or an item of importance to the public be placed on a city council agenda. The city council member shall make his or her request in writing and submit such request to the city secretary. The item for consideration shall be placed on the next regular city council meeting agenda, unless the time to post said agenda has elapsed pursuant to the Texas Open Meetings Act.

No city council member, or the mayor, shall have the right to unilaterally manage, reprimand, discipline, or take any negative employment action concerning a city employee. Any such action shall only be allowed by a majority vote of the city council, or by a two-thirds vote of the city council should such be required by state law.

A city council member, including the mayor, shall have the right to inspect and receive copies of documents related to the city. The council member desiring to review or receive copies of any such documentation should make the request in their official capacity as a member of the city council and make such request in writing. Copies of requested documents shall be made available for review at city hall, and copies shall be furnished to the city council member upon request. The privacy rights of employees shall, at all times, be protected. Additionally, in the event that any document requested contains information that is excepted from disclosure under federal or state law, such information shall be protected accordingly. Such protection shall be afforded to any record concerning an employee, independent contractor or individual when such information is protected by federal and/or state law or common law privacy rights.

The city secretary is hereby given authorization to contact the city’s attorney regarding any matter involving city business and/or a matter of concern regarding council procedure and policy. This authorization shall be general in nature, and shall allow the city secretary to contact the city attorney on any matter deemed necessary by the city secretary to ensure legal compliance and/or guidance on all matters related to the city.

A violation of any provision of this article shall be punishable as a class C misdemeanor. In the event of a guilty finding, a fine may be assessed in an amount in accordance with the general penalty provided in section 1.01.009 of this code.
