Any person violating this article shall be deemed guilty of a misdemeanor and shall be fined in accordance with the general penalty provided in section 1.01.009 of this code.

It shall be unlawful for any person to keep or maintain cattle, horses, poultry, sheep or goats in any pen, or on any place or keeping as “stud or bull service” or “feeding out” for resale, within the corporate limits of the city, at a distance of less than five hundred (500) feet from any church, residence, school, dwelling, eating establishment or place of business; provided that this distance requirement shall not apply to the dwelling of the owner himself.

It shall be unlawful for any person to keep cattle, horses, poultry, sheep or goats in small restricted enclosures and permit the droppings or excreta of the animals to accumulate in the pen. The accumulation of droppings or excreta in any pen where cattle, horses, sheep, or goats are kept is hereby specifically declared to be a nuisance dangerous to the public health.

Any pen, place or condition as covered in sections 3.03.002 and 3.03.003, regardless of location, wherein cattle, horses, sheep, or goats are kept shall be maintained and kept in such a manner as not to become unsanitary, offensive or disagreeable to persons residing in the vicinity thereof, nor shall they be so maintained or kept as to breed flies or in any manner cause any injury to the health of the public or any person residing in the vicinity of the said pen or enclosure. Any such pen as covered in this section is subject to regulation by reason of the city’s police powers.

It is hereby prohibited and it shall be unlawful for any person to offer for sale, keep, maintain, harbor or permit in the city any swine that is of the breed and/or is being bred to be sold on the open market or processed for consumption.

It shall be an exception to the prohibitions of this chapter when an animal is kept, harbored or maintained by a participant in an agricultural program under the supervision of a vocational instructor or a county agricultural agent for exhibition and/or sale at stock shows or like exhibitions.
