No person shall transport or possess on his person or in a motor vehicle any beer, wine, or alcoholic beverage in an open container in or upon the streets, sidewalks, alleys, or public ways of the Borough of Myerstown, nor in or upon the parking areas of private property, nor in or upon property owned or leased by the Borough of Myerstown.

Any person who violates any provision of §§6-101 and 6-102 of this Part shall be guilty of an offense, and, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $25 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.
