Vehicles exceeding 25 feet in length possessing a hauling capacity in excess of 2,000 pounds used primarily for business or industrial purposes hereby are prohibited from operation except for local delivery within the residential areas of the Borough.

No commercial equipment including, but not limited to, unhitched trailers, trucks, tandems (in excess of one ton capacity), tractor trailers, tractors, or other commercial construction, or cargo moving vehicles or equipment shall be parked upon any highway or street within the Borough of Myerstown between the hours of 9:00 p.m. and 6:00 a.m.

The following are exceptions to the restrictions set forth:
A. 
Any commercial equipment described in this Part may legally park for the purpose of delivering goods or rendering services during the normal course of business; provided, that such vehicle does not substantially impede the flow of vehicular traffic.
B. 
Vehicles being used for the purpose of road construction shall be permitted to park, stand, or stop on any highway or street within the Borough of Myerstown when construction is in progress upon said highway or street.
2. 
The following exceptions will be considered by Council action prior to the mobilization of equipment:
A. 
Vehicles being used for the purpose of permitted residential construction or reconstruction at individual residences shall be permitted to park, stand, or stop on any highway or street within the Borough of Myerstown when construction is in progress upon said residence: provided, that such vehicle does not substantially impede the flow of vehicular traffic.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $100 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.

In addition to the penalties herein provided, whenever any police officer finds an attended vehicle in violation of any provisions of this Chapter, the officer may move the vehicle, or cause the vehicle to be moved, or require the driver or other person in charge of the vehicle to move the vehicle, to a position off the roadway.
