The burial of human remains in recognized cemeteries in the Township is preferred, although not required, and shall follow the regulations of the recognized cemetery if more restrictive than the requirements herein.
Permits for burial are required prior to any interment and will be issued by the Patton Township Zoning Officer.
All interments occurring in family burial cemeteries will require the following additional requirements:
A. 
All burials must conform to the following depth of graves requirements:
(1) 
The distance from parts of the top of the outer case containing the casket may not be less than three feet (36 inches) from the natural surface of the ground.
(2) 
When a casket is not placed in an outer case or when a body is not placed in a casket, the distance from parts of the casket or body may be no less than four feet (48 inches) from the natural surface of the ground.
B. 
The area of excavation shall have a minimum setback requirement of 30 feet from all property lines.
C. 
The area of excavation shall have a minimum setback requirement of 100 feet from any private or public water wells, wetlands, or other watercourses.
D. 
No burials are permitted within the 100-year floodplain.
E. 
The minimum size of the tract or parcel on which the burial of human remains is allowed shall be one acre.
F. 
A maximum of four interments may occur per one acre of land.
G. 
All burial sites must be marked with a permanent marker made of stone, metal, or other durable material so that the area is not disturbed. A map or survey showing the burial site location, or geographic coordinates of the burial site location, must be provided with the permit application.
H. 
All family burial cemeteries shall be accessible from at least one public or private roadway.
I. 
Any deed conveying a property containing a family burial cemetery shall reflect the restriction and/or reservation for the family burial cemetery and should identify what party(s) shall be responsible for its maintenance. The deed shall include, or be accompanied by, a suitable access easement to provide perpetual access for family members of the deceased.
Any of the provisions of this chapter shall be enforceable pursuant to § 425-72, Violations and penalties.
