As used in this article, the following terms shall have the meanings indicated:
PUBLIC AREA OF THE VILLAGE
A. 
Public roadways, streets and sidewalks;
B. 
Public rights-of-way and grassy areas adjacent to a public roadway, street or sidewalk;
C. 
The area between a curbline or lateral line of a roadway and the adjacent private property line; and
D. 
A garage, driveway, yard, parking lot or other property owned or leased by the Village.
PERSON
An individual, association, group or legal entity such as a corporation, partnership or limited-liability company.
COMBUSTIBLE MATERIAL
Material that, in the form in which it is used and under the conditions anticipated, will ignite, burn, support combustion or release flammable vapors when subjected to fire or heat.
No person, group or entity shall conduct or engage in an activity which imposes a fire risk in any public area of the Village, or within 10 feet adjacent thereto, except as authorized by §§ 114-52 and 114-53 herein. Such activities include, but are not limited to, the use of a barbecue or grill, however powered; the setting or maintenance of a fire, whether open or protected; the use of fireworks; and the placement of combustible materials.
The Village Board of Trustees, after written application and a public hearing, may issue a special permit authorizing activities otherwise prohibited herein, and may establish such conditions as it deems necessary and appropriate for the conduct of such activity, including, but not limited to, security, insurance and cleanup. The fee for such a permit application shall be $250, which may hereinafter be modified by resolution.
Any person who violates any provision of this article shall be subject to a fine up to the following amounts, plus imprisonment for a period not exceeding 15 days: first violation – $250; second violation within a twelve-month period – $350; third and additional violations within a twelve-month period – $500.
