Town of Yountville parks are open daily from sunrise to sunset. Unless the hours are specifically extended by the Town to accommodate a special event, no person shall enter, loiter, or remain in or upon any Town park at any time between the hours of sunset to sunrise except as may otherwise be posted at the entrance to the park or as approved by the Town Council or Town Manager.

A. 
No person shall use skateboards, rollerblades, roller skates, or scooters on tennis courts or bocce ball courts in Town parks.
B. 
No person shall use, operate or strike a skateboard, rollerblades, roller skates, or scooters against, onto or upon the side of buildings, fences, steps, benches, tables, play equipment, walls, curbs, rails, ramps or similar objects or structures in Town parks or on any other public property.
C. 
No person shall apply any foreign substance, including wax, oil, or other similar material, either as a solid or liquid, onto any curb, stair, railing, ramp, sidewalk, bench or other abutment in Town parks or on any other public property for the purpose of aiding any stunt, turn or other acrobatic action performed while riding a skateboard, rollerblades, roller skates, or scooters.

No person shall operate or drive an automobile, bicycle, motorcycle, truck, trailer, wagon, motor scooter or other conveyance on roads or paths not designated for that purpose or as permitted by the Town Manager. Bicycles shall be wheeled or pushed by hand over any grassy area, trail or path reserved for pedestrian or other conveyances and shall at all times be operated with reasonable regard for the safety of others. In no event shall the maximum speed of any such conveyance exceed 15 miles per hour within the park facility or exceed the speed limit posted. All such conveyances when left unattended shall be left in an area and in the proper manner designated.

A. 
No person shall mark, deface, disfigure, injure, tamper with, pollute, displace or remove any building, bridge, table, bench, fireplace, railing, fence, paving, water line or other utility, monument, stake, post or other structures, equipment, facilities or appurtenances in any Town park.
B. 
No person shall engage in any game, actions or conduct injurious to any trees, shrubs, plants, turf, flowers or other property in any Town park.
C. 
No person shall misuse, damage, cut, carve, transplant or remove any tree, plant, wood, turf or ground cover, or pick the flowers or seeds of any tree or plant in any Town park.
D. 
No person shall climb any tree or walk, stand or sit upon monuments, vases, fountains, railings, fences or upon any other property not designated or customarily used for such purposes in any Town park.
E. 
No person shall attach to any tree, plant or other object in a Town park any rope, wire, sign, banner, decoration, device, equipment or other object except on a temporary basis while such person is present and only in a manner which does not damage or deface Town property.

No person shall fail to cooperate in maintaining restrooms and washrooms in a neat and sanitary condition. Further, no person shall loiter in or about such facilities nor shall any person use such facilities for purposes other than those intended.

No person shall hunt, molest, harm, frighten, kill, trap, chase, tease, shoot or throw objects at any animal, reptile or bird, remove or possess the young of any wild animal, reptile or bird or the eggs or nest or young of any reptile or bird.

No person, other than peace officers in the discharge of their duties, shall possess, carry or use firearms of any description, air or gas rifles, spring guns, bows and arrows, slings or any other form of weapon potentially inimical to wildlife and dangerous to human safety, or any kind of trapping device. The mere possession of such firearm or device herein specified in any Town park shall be a violation of this section, whether such firearm or device is loaded or unloaded.

No person shall dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or refuse or other trash except in the receptacles provided by the Town.

No person shall post or affix any handbill, circular, pamphlet, paper, notice or advertisement to any tree, fence or structure in any Town park without permission of the Town Manager, except as allowed in Section 12.12.040(E).

No person, other than one acting under authorization, direction or permission of the Town, shall build, light, kindle or maintain any open or outdoor fire at any place within the boundaries of land or water owned, managed, controlled or operated as a Town park except in areas or facilities specifically designed and built for this purpose.

No person shall possess, sell or consume alcoholic beverages in Town parks, unless approval by a special event permit, except that beer and wine may be possessed or consumed in Forrester, Veterans, Vineyard and Yountville parks.

No person shall possess in a Town park any hatchet, axe, machete, brush knife or any other device, other than a legal pocket knife and/or cutlery necessary for preparation of food, capable of cutting, defacing or mutilating trees or shrubs.

No person shall park, abandon or otherwise allow to remain within any Town park any automobiles or other conveyances when the park is closed.

No person shall drive, putt or in any other fashion play or practice golf or use golf balls or golf clubs within any Town park, except in areas set aside for those specific activities.

No person shall wear shoes or foot coverings that will damage, injure or create the need for excessive maintenance on any field, park, turf or specialized surface prepared for particular games or activities. In areas posted with a sign specifying footwear authorized or approved, no person shall enter any such area in other than the required footwear.

No person shall fly model airplanes in any Town park, except in areas set aside for those specific activities.

No person, or group of people, shall use a park for any commercial purpose, including the sale of any service, merchandise or food, except by permit issued by the Town Manager.

Organized groups are defined as a sports team, sports leagues, class groups, and any other group with more than 25 attendees but less than 200 attendees. No person, or group of people, shall use a park for organized group use except by permit issued by the Town Manager. Events with 200 or more attendees are classified as a special event and require a special events permit pursuant to Chapter 8.24.

A. 
No person, owner/guardian or responsible party shall permit a dog to enter upon land or water owned, managed, controlled, or operated as a Town park (including any playground, tot lot, or other park or playground facility), except as provided by Section 6.04.060, 6.08.010, 6.08.020 and 6.08.030 which are related to animal control and control of dog excrement.
B. 
No person, owner/guardian or responsible party shall permit a dog to enter into any park area that is posted as a play area for children, including sand or wood-chip covered play equipment areas or other fenced tot lots, or play areas with the exception of service dogs.

All parks and recreation areas, as defined herein, are hereby designated as "No Smoking" areas. In Town parks and recreation areas, the use of "tobacco products," defined to include, but not be limited to, cigarette smoking, cigars, pipes, hookahs, clove or other smoking products, is prohibited. In Town parks and recreation areas, the use of marijuana or other controlled cannabis substances, including those products legally authorized for use by a qualified patient as set forth in current State law or those products and substances illegally used or possessed is prohibited. The term "parks and recreation areas" is defined as parks, trails, landscaped areas proximate to recreational facilities including the Community Center and Community Hall and any other similar facilities. In declaring Town park and recreation areas as "No Smoking" areas, these areas are subject to Health and Safety Code Section 11362.79 which prohibits the use of marijuana or other controlled cannabis substances in any place where smoking is prohibited by law.
Notwithstanding the foregoing, the use of nicotine patches attached to a person or the use of nicotine gum is not prohibited.

A. 
The Town Council may by resolution establish regulations governing use and operation of Town parks, recreational areas, public spaces, and parts thereof, including, but not limited to, additional or different regulations than those otherwise prescribed in this chapter. If different than the regulations otherwise prescribed in this chapter, such rules or regulations when established by resolution of the Town Council shall supersede the regulations otherwise prescribed in this chapter.
B. 
Copies or signage displaying the regulations described in subsection A shall be posted at each Town park, recreational area, or public space to which the regulation applies and, upon posting of such copies or signage, a violation of any such regulation shall be a violation of this code and subject to enforcement under Chapter 1.20 and/or Chapter 8.05 in addition to any other enforcement remedy authorized by law.
