Pursuant to the authority granted by Chapter 755 of the Wisconsin
Statutes, there is hereby created and established a Joint Municipal
Court of the City of Reedsburg, Town of LaValle, and Village of Loganville.
This Joint Municipal Court is to become operative on March 24, 2022.
Qualifications. The Joint Municipal Court of the City of Reedsburg,
Town of LaValle and Village of Loganville shall be under the jurisdiction
of and presided over by a Municipal Judge, who shall be an attorney
licensed to practice law in Wisconsin and who resides in the City
of Reedsburg, Town of LaValle, or Village of Loganville.
Hours. The Joint Municipal Court for the City of Reedsburg,
Town of LaValle, and Village of Loganville shall be open as determined
by order of the Municipal Judge.
The Municipal Judge may impose punishment and sentences as provided
by Chapters 800 and 938, Wis. Stats., and as provided in the ordinances
of the City of Reedsburg, Town of LaValle, and Village of Loganville.
All forfeitures, fees, assessments, surcharges and costs shall be
paid to the Treasurer of the City of Reedsburg within seven days of
receipt of the money by the Municipal Court.
A. The Joint Municipal Court funds shall be deposited into a separate
special revenue fund created solely for the purpose of managing revenues
and paying expenses: labor/benefits, operating and transfer of funds
to support internal services and capital expenditures.
B. Changes do not adjust Chapter
434, Peace and Good Order, §
434-7, Bond schedules, approvals. A certified copy of bond schedules for the offenses set forth in this code shall be adopted and approved with the text as part of this code and shall bear upon its face the attestation of the City Clerk-Treasurer and the Chief of Police and shall be available to the public in the office of the Chief of Police.
C. Changes thereafter to the bond schedule shall not be effective until
entered and attested on the certified copy. Changes in the bond schedule
shall be made by the Chief of Police with the approval of the Council.
All approved changes shall be incorporated into the bond schedule
and shall be available for public inspection.
D. At the time of the payment, the Joint Municipal Court shall report
to the City Treasurer the title of the action, the nature of the offenses
and total amount of judgments imposed in actions and proceedings in
which such monies were collected.
E. Distribution of Joint Municipal Court revenue to contracted cities,
villages and towns shall be authorized by the Municipal Judge and
may be adjusted and memorialized in a fees resolution.
The Municipal Judge may impose punishment and sentences as provided
by Chapters 800 and 938 Wis. Stats., and as provided in the ordinances
of the municipalities that are parties to the agreement. All forfeitures,
fees, assessments, surcharges and costs shall be paid to the treasurer
of the municipality within which the case arose within 30 days after
receipt of the money by the Municipal Court. At the time of the payment,
the Municipal Court shall report to the treasurer the title of the
action, the nature of the offenses and total amount of judgments imposed
in actions and proceedings in which such monies were collected.
The Joint Municipal Court hereby established shall not be abolished
while the § 755.01(4) agreement is in effect.
