The purpose of this Article is to establish provisions relating to dog parks and to provide an area for dog owners to bring their dogs to enjoy being off-leash.

means a County park or an area within a County park that has been designated for use as an offleash dog area by the Director and for which rules and regulations are established.

(a)
The Director is authorized to set aside areas within County parks for dog parks. In designating dog parks as off-leash parks, the Director shall consider the park's size, location, and frequency of use by members of the public, as well as the primary actual or designed use of each park or area included in the designation. Parks that are designated for family use, picnic grounds and sports activities shall not be designated as dog parks. The Director shall post appropriate signs to notify the public of such designation which shall consist of a map that delineates the dog park area.
(b)
Dogs shall be permitted only in designated dog parks, with the exception of traversing through County property to enter into the established dog park.
(c)
While in a County dog park, the owner of a dog shall be responsible for the actions of the dog (i.e., remove any waste deposited by the dog, have control of dog at all times). Any individual who traverses through a County park to enter into the established dog park and/or brings a dog into a County dog park shall comply with the rules established by the Director of Parks and Recreation.
(d)
The Director shall establish rules and regulations pertaining to dog parks that shall include, but not be limited to, hours of operation, the prohibition of dogs deemed dangerous under Article 17 of this Chapter, and policies regarding maintenance and closures.

(a)
There shall be provided for use by officers authorized to enforce laws relating to the regulation and control of dogs, a form of complaint and summons or citation for citing violators of the provisions of this Article or the provisions of Chapter 143, H.R.S. The complaint and summons or citation shall be printed in a form commensurate with the form of other summonses or citations appropriate for offenses, and so designed to include all necessary information to make the same valid and legal within the laws of the State of Hawai'i and the County of Kaua'i.
(b)
Every summons or citation shall be consecutively numbered and each carbon copy shall bear the number of its respective original.

It shall be unlawful for any person to fail to appear at the place and within the time specified in the summons or citation issued to him or her by an officer for any violation of any Section of this Article. A negotiated bail forfeiture in lieu of an appearance shall be unlawful.

Any person convicted of a violation of any Section or provision of this Article shall be punished by a fine of not less than fifty dollars ($50.00) and not to exceed one hundred fifty dollars ($150.00) for the first conviction. For the second conviction, the punishment shall be by a fine of not less than one hundred dollars ($100.00) and not to exceed two hundred dollars ($200.00). For all convictions in excess of two (2), the punishment shall be a fine of one hundred fifty dollars ($150.00).

Nothing contained in this Article shall preclude any person injured by a dog from bringing a civil action against the owner of such dog pursuant to the applicable provisions of State law.
