For the purpose of this chapter, "truck" means any vehicle as defined in the Vehicle Code of California, or as hereafter amended, exceeding a maximum gross weight of three tons.

The following truck traffic routes within the city of Sunnyvale are hereby established for the movement of any truck as defined in Section 10.40.010:

The city traffic engineer is directed to designate the above-named streets by appropriate signs as "Truck Routes," which method of designation the city council has determined will best serve to give notice of this chapter.

Whenever any ordinance of this city designates and describes any street or portion thereof as a street the use of which is permitted by any vehicle exceeding maximum gross weight limit of three tons, the city traffic engineer is authorized to designate such street or streets by appropriate signs as "Truck Traffic Routes" for the movement of vehicles exceeding a maximum gross weight limit of three tons.

(a)
When authorized signs are in place giving notice thereof, no person shall operate, drive, or cause or permit to be operated or driven a truck as defined in Section 10.40.010 on any street or streets within the city of Sunnyvale other than on a truck traffic route except as otherwise provided in this chapter.
(b)
When any such truck traffic route or routes are established and designated by appropriate signs, the operator of any vehicle exceeding a maximum gross weight of three tons shall drive on such route or routes and none other except that nothing in this section shall prohibit the operator of any vehicle exceeding a maximum gross weight of three tons coming from a "Truck Traffic Route" having ingress and egress by direct route to and from restricted streets when necessary for the purpose of making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on such restricted streets or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon such restricted streets for which a building permit has previously been obtained therefor. The provisions of this section shall not apply to (1) passenger buses under the jurisdiction of the public utilities commission, or to (2) any vehicle owned by a public utility while necessarily in use in the construction, installation or repair of any public utility.

Those streets and parts of streets designated by resolution of the city council are truck routes for the movement of vehicles exceeding a maximum gross weight of three tons.

Any officer of the department of public safety of the city of Sunnyvale shall have the authority to require any person driving or in control of any vehicle as defined in the Vehicle Code of California, or as hereafter amended, not proceeding over a truck traffic route to proceed to any public or private scale available for the purpose of weighing and determining whether this chapter has been complied with.

Nothing contained in this chapter is intended to regulate the movement of any vehicle as defined in the Vehicle Code of California, or as hereafter amended, upon any of the following named highways, portions of which are located within the city of Sunnyvale, and which are referred to in this chapter as "unrestricted highway":
Bayshore Freeway
Central Expressway
El Camino Real
Junipero Serra Freeway
Lawrence Expressway
Mountain View-Alviso Freeway
Stevens Creek Freeway

Any truck as defined in Section 10.40.010:
(a)
Entering the city of Sunnyvale for a destination point outside the city shall proceed only over a truck route or other unrestricted highway;
(b)
On a trip originating within the city of Sunnyvale and traveling in the city for a destination point outside of the city, shall proceed by the shortest and most direct route to the nearest truck route or other unrestricted highway;
(c)
Entering the city of Sunnyvale for one or more destination points in the city shall proceed only over a truck route or other unrestricted highway, and shall deviate therefrom only by the shortest and most direct route between each destination point and the nearest truck route or other unrestricted highway;
(d)
On a trip originating in the city of Sunnyvale and traveling in the city for one or more destination points in the city shall deviate therefrom only by the shortest and most direct route between each destination point and the nearest truck route or other unrestricted highway;
(e)
Traveling in the city of Sunnyvale for more than one destination point in the city may proceed directly from one destination point to the next destination point by the shortest and most direct route without returning to the nearest truck route or other unrestricted highway if it will result in a shorter distance being traveled on streets upon which such a truck ordinarily would not be allowed to travel notwithstanding the requirements of subsections (c) and (d).

The provisions of this chapter shall not apply to any of the following:
(a)
Passenger buses under the jurisdiction of the Public Utilities Commission of California, and school buses;
(b)
Any authorized emergency vehicle as defined in Section 165 of the Vehicle Code of California, or as hereafter amended;
(c)
Any vehicle owned, leased, operated or controlled by:
(1)
The city of Sunnyvale,
(2)
A public utility or licensed contractor while necessarily in use in the construction, installation, or repair of any public utility, within the city,
(3)
The holder of a franchise issued by the city of Sunnyvale for the removal of garbage, waste or refuse, and
(4)
Any licensed contractor while necessarily in the construction, maintenance, or repair of a public works project on which bids were opened by the city of Sunnyvale prior to the adoption of the chapter unless an alternate direct route is provided substantially within the city of Sunnyvale.

Wherever any ordinance or resolution of this city designates and describes any street or portion thereof as a street the use of which is prohibited by any commercial vehicle, the city traffic engineer shall erect and maintain appropriate signs on those streets affected by such ordinance. Those streets and parts of streets designated by resolution of the city council are streets the use of which is prohibited by any commercial vehicle. The provisions of this section shall not apply to passenger buses under the jurisdiction of the Public Utilities Commission.
