The purpose of this chapter is to provide regulation for the location, design, and screening of refuse and recycling facilities and their enclosures.

A. 
Trash Receptacle Required. Every parcel with a multifamily, commercial, or industrial structure shall have a trash receptacle (i.e., Dumpster) on the premises. The trash receptacle shall meet the requirements of the entity with the responsibility for solid waste collection and shall be of sufficient size to accommodate the trash generated.
B. 
Recycling Facility Required. In addition to a trash receptacle, every applicable development project, as defined in this section, shall have facilities for recycling bins for paper, glass, and cans. The recycling facilities shall be located adjacent to the trash receptacle and shall be of a size at least equal to that occupied by the trash receptacle in adequate size and quantity to allow for the collection and loading of recyclable materials generated by the development project. Recycling facilities are required for the following development projects:
1. 
A project for which a Building Permit will be required for a commercial, industrial or institutional building, or residential building having five or more living units, where solid waste is collected and loaded.
2. 
Any existing development project for which an application for a Building Permit is submitted for a single alteration or multiple alterations which add 30% or more to the existing floor area of the development project. Any costs associated with adding recycling space to existing development projects shall be the responsibility of the party or parties who are responsible for financing the alterations.

The combined area used for recycling and trash shall be known as the refuse and recycling area. The following provisions apply to this area:
A. 
The refuse and recycling area shall be located away from streets and enclosed or screened by landscaping, fencing, or other architectural means. The refuse and recycling area shall be enclosed on at least three sides by a solid masonry wall or wood fence six feet in height.
B. 
The refuse and recycling area shall be enclosed on the fourth side or on any portion of the fourth side by a solid gate at least five feet in height. The gate shall be maintained in good working order and shall remain closed except when in use.
C. 
The enclosure and gate of the refuse and recycling area shall be designed to be architecturally compatible with nearby structures.
D. 
The refuse and recycling area shall include adequate, accessible, and convenient areas for storage of all bins and containers and collecting and loading recyclable materials.
E. 
The driveways and aisles serving the refuse and recycling area shall provide unobstructed access for collection vehicles and personnel.
F. 
The refuse and recycling area shall be located such that the maneuvering of collection vehicles does not disrupt automobile movements.
G. 
The design, construction, and location of refuse and recycling areas shall not be in conflict with any applicable Federal, State, or local laws relating to fire, building, access, transportation, circulation, or safety.
H. 
Refuse and recycling areas or the bins or containers placed therein must provide protection against adverse environmental conditions, such as rain, which might render the collected materials unmarketable.
I. 
A sign clearly identifying all recycling and refuse collection and loading areas and the materials accepted therein shall be posted adjacent to all points of direct access to the refuse recycling areas.
J. 
Developments and transportation corridors adjacent to recycling and refuse areas shall be adequately protected from any adverse impacts such as noise, odor, vectors, or glare through measures, including, but not limited to, maintaining adequate separation, fencing, and landscaping.
