For the purpose of this chapter, certain words shall be defined as follows:
A. 
"Park" means any area dedicated or established as a public park.
B. 
"Street" means any public street, public way, public alley, public thoroughfare, public lane, or parkway upon or along any public street or public way.

The parks foreman shall have the following powers and duties in addition to such other powers and duties as may be prescribed by law or the ordinances of this city.

The parks foreman shall plant, care for and maintain trees, plants and shrubs in the parks and on all of the streets and parkways of the city.
He shall exercise jurisdiction and control over the planting and care of trees, plants and shrubs in the parks and in all of the streets and parkways of this city, whether done by public or private means.

The parks foreman shall have charge of and direct and supervise the removal, trimming, pruning and cutting of trees, plants and shrubs in the parks and on the streets and parkways of this city; and to issue all permits for the replacement, removal, planting, cutting, destruction and/or trimming of such trees, shrubs and plants, provided that permits for removal or destruction shall not be valid until such permit is approved by the signature of the city manager thereon.

The parks foreman shall determine the variety of trees, plants and shrubs that may be planted in the parks and upon or along any street or parkway of the city and distance apart at which said trees, plants and shrubs shall be planted.

The parks foreman shall inspect trees, plants and shrubs in the parks and in all streets and parkways in the city for infection from scale, plant or animal life or growth, or any insects detrimental to the growth, health or life of trees, plants or shrubs and to remove and destroy such infected trees, plants or shrubs.

It is unlawful for any person, firm, or corporation to plant, remove, destroy, cut, prune or deface, or in any manner to cause or permit to be planted, removed, or destroyed, cut, pruned or defaced, any tree, plant, or shrub, in the parks or on any street in this city without first obtaining a written permit so to do from the parks foreman.

it is unlawful for any person, firm or corporation, without having first obtained a written permit from said parks foreman to attach any sign, electric wire, insulator, or any other device for holding electric wire, to any tree now or hereafter growing in the parks or on any street in this city; and every person, firm or corporation having any wire or wires charged with electricity shall securely fasten or change the location of same so that such wire or wires shall not injure any tree in any street or park.

No person shall cause or permit any brine water, oil, liquid dye or other substance harmful to tree life, to lie, pour, flow or drip on or into the soil upon the base of a tree in any public street in this city or onto a sidewalk, way or pavement therein at a point whereby said substance by lying on, or by flowing, dripping or seeping into such soil, or in any other manner injure such tree; or cause or permit such lying, leaking, flowing, dripping, seeping or injury.
It is unlawful for any person, firm or corporation owning, maintaining or operating any gas pipe or mains laid beneath the surface of any street or private land in this city to permit any leak to occur in such pipes or mains within a radius of forty feet of any tree now or hereafter growing in any street or park of this city.

In the event any leak exists or occurs in any such pipe or main, it shall be the duty of such person, firm or corporation owning or operating such defective pipe or main to repair the same immediately and stop such leak in a manner so as to prevent a recurrence of the same after receiving a notice in writing from the parks foreman calling the attention of such person, firm or corporation to the fact that such leak exists or has occurred.

During the erection, repair, alteration or removal of any building or structure within this city, it is unlawful for the person or persons in charge of such erection, repairs, alteration or removal to leave any street tree in the vicinity of such building or structure without good and sufficient guards or protectors to prevent injury to said tree, arising out of or by reason of said erection, repair, alteration or removal.
