No person shall construct or erect any building or structure for which a building permit is required under the provisions of this title without first having obtained, in addition to any and all other permits required by this code, an elevation permit from the city engineer pursuant to the provisions of this chapter.

Every person required to obtain an elevation permit shall make application therefor upon forms provided by the city engineer and shall include in the application such data as may be required to evaluate whether or not the building or structure would be subject to storm or drainage hazards and whether or not the building or structure would change or interfere with or impede the flow of storm or drainage waters.

A fee as required by the city council for the issuance of the elevation permit shall be paid at the time of application.

If the city engineer finds that the proposed building or structure will be subject to damage by storm or drainage waters or that the building or structure will change or interfere with or impede the flow of storm or drainage waters, he shall refuse to issue a permit; provided, however, the city engineer shall have the right to issue a permit which shall be conditioned upon the applicant constructing the building or structure at such a level as will not subject it to the hazard of storm or drainage waters or that storm or drainage waters will not be changed or impeded. Such permit may be further conditioned upon the applicant constructing such facilities as will prevent the endangering of the public health, safety or welfare.

Any applicant who is refused an elevation permit or asserts that the conditions imposed are unwarranted shall have the right to appeal the decision of the city engineer, within ten days after the decision, to the city council. The appeal shall be in writing and shall contain the reasons for appeal and the facts upon which the applicant relies. The city council shall consider the appeal and s all either affirm, disaffirm or modify the decision of the city engineer.

No person shall fail to comply with the conditions of an elevation permit issued by the city engineer or as finally determined by the city council in the event of an appeal.
