The purpose of this title is to establish a Storm Water Enterprise and utility in order to facilitate the obtaining by the City of a storm water discharge permit from the U.S. Environmental Protection Agency through its National Pollutant Discharge Elimination System Permit Application Regulations for Storm Water Discharges, and otherwise to facilitate the management of storm water runoff in order to control and reduce flooding, property damage, erosion, and water quality degradation, all to preserve and enhance the public health, safety and welfare and the quality of life of the citizens of the City of Santa Rosa.

The powers conferred by this title are in addition to, and the limitations imposed by this title do not affect, the powers conferred by any other law.

The provisions of this title shall be controlling over the provisions of any general law or act in conflict herewith in any proceeding taken under this title.

This title is adopted pursuant to municipal affairs provisions of the charter of this City. In proceedings conducted pursuant to this title, which are a municipal affair, the general laws herein referred to are deemed a part of this title.

In the event that any act or proceeding taken or conducted pursuant to this title shall be adjudged a state affair, it is hereby declared to be the intention of the Council that said act or proceeding was taken or conducted pursuant to the general law or laws cited in this title.

If the jurisdiction of the Council to order the proposed act is not affected, the defect or omission of any officer of the City or the City in proceedings under this title does not invalidate the proceeding under this title or bonds issued under the bond law.

It is the understanding and intent of the Council that the charges are, as a matter of law, special assessments levied as a measure of the benefits to all properties in the city from the improving, management and operation of the Storm Water Enterprise. The Council declares that it would have adopted the ordinance adding this title and imposed the charges even though it may be determined that the levy is in law not a special assessment, but some other form of taxation which may be lawfully imposed by the City.
