For the purpose of this chapter the following words and phrases shall have the meanings respectively ascribed to them:
"Director"
means the director of finance.
"Owner"
means a person who has an ownership interest in a parcel of real property within a residential permit parking zone designated pursuant to this chapter.
"Resident"
means a person who lives in a residential permit parking zone as his or her permanent place of residence, either as a tenant or owner.
"Residential parking permit"
means a permit issued pursuant to this chapter.
"Residential permit parking zone"
means a residential zone designated as provided in this chapter wherein vehicles displaying a valid permit issued pursuant to this chapter shall be exempt from the parking time restrictions established for the permit parking area.
"Vehicle"
means an automobile, truck, trailer, house car, motorcycle or other motor driven device for transportation, not in excess of 6,000 pounds gross weight.

Residential parking permits shall be issued by the director of finance. Parking permits may be issued to an owner or resident of a property within a residential parking permit zone or to a guest of such an owner or resident duly authorized by the owner or resident to apply for a residential parking permit; provided, that a residential parking permit shall only be issued to an owner or resident, who has a motor vehicle currently registered in his or her name, or who has lawful possession of a motor vehicle for his or her exclusive use and/or which is under his or her control and to individuals providing in home medical care to a resident of a zone; provided, that the in home provider shows proof, in the form of a contract or other agreement, of the service being provided. Not more than one residential parking permit shall be issued for any motor vehicle. The city manager may establish rules and regulations necessary or appropriate to carry out the purpose of this chapter. The city manager shall require each applicant for a residential parking permit to establish proof of residency and vehicle ownership, possession or control in compliance with this chapter.

There shall be no limit to the number of annual permits issued to any residential address within a residential permit parking area; provided, that the resident owns or has control over each of the vehicles for which an annual permit is issued. A separate application shall be filed for each motor vehicle. Each residential parking permit issued by the director shall be valid for a maximum of one year unless otherwise stated on the permit. The city manager shall cause to be prepared and issue effective on or about September 1st of each year, a distinctively colored sticker for issuance to permittees of residential parking permits, which sticker shall be affixed to the motor vehicle for which a permit is issued at the location specified in Section 11.38.050 of this chapter.

Not more than two guest permits shall be issued for any dwelling unit. Guest permits shall be issued to residents in a residential parking permit zone and may be issued at the same time as the annual permit. Guest permits shall not be used for regular vehicle usage nor to bypass the need to buy an annual permit. Residents who abuse guest pass privileges shall have their annual permit privileges revoked for up to one year.

Residential parking permits shall be affixed to a motor vehicle at the left rear bumper. Guest permits shall be placed inside the vehicle, visible through the rear window on the driver's side or attached to the rearview mirror.

The council may establish by resolution fees for the issuance of residential parking permits, guest permits and for the replacement of lost, damaged or destroyed permits or stickers. Residential parking permits shall be valid for not more than one year, unless otherwise stated on the permit and every permit shall be renewable prior to September 1st of each year.

Permits shall terminate upon any of the following events:
A. 
Upon the transfer or sale of the vehicle for which a permit has been issued.
B. 
Upon the relocation of the permittee from his or her residence within a residential parking area to another residence, whether within or outside said zone.
C. 
Upon expiration of the time period for which a permit has been issued.

Upon the adoption of a resolution by the council designating a residential permit parking zone and appropriate parking time restrictions, the city manager shall order appropriate signs to be erected in such area indicating prominently thereon the time limitation, day or days, and hours during which parking shall be restricted.

A. 
It is unlawful and a violation of this chapter, unless expressly provided to the contrary in this chapter, for any person to park a motor vehicle on a street in a residential permit parking zone in excess of the parking time limit posted by signs giving notice thereof and erected pursuant to this chapter, without a valid residential parking permit for that zone properly affixed to such vehicle.
B. 
It is unlawful and a violation of this chapter for a person falsely to represent himself or herself as eligible for a residential parking permit or a guest permit or to furnish false information in an application for any such permits.
C. 
It is unlawful and a violation of this chapter for any person to use or display, or permit the use or display of, a residential parking permit or a guest permit or a sticker pertaining thereto on a motor vehicle other than that vehicle for which such permit or sticker was issued.

A. 
Any motor vehicle on which is displayed a valid residential parking permit, temporary permit or sticker pertaining thereto, as provided for in this chapter may be parked on a street in the residential permit parking zone pertaining thereto without limitation of the time restrictions established by the council under Section 11.38.080 of this chapter. Such parking permit shall not guarantee or reserve the holder thereof an on street parking space on a street in such residential permit parking zone or exempt the vehicle from any other restrictions, ordinances or codes.
B. 
This chapter does not apply to ambulances, fire department vehicles, police vehicles, public utility vehicles or other official or emergency vehicles while conducting official business which have an official seal or logo identifying them as such.
C. 
Clearly marked vehicles with commercial license plates parked for the purpose of loading or delivery of goods, wares or merchandise from or to any building or structure in a residential permit parking zone or delivering materials to be used in the repair, alteration, remodeling, construction or reconstruction of any such building or structure for which a building permit has previously been obtained, or vehicles used for commercial residential maintenance including, but not limited to, landscapers and repairmen doing work for residents in the zone shall be exempt from the time restrictions established by the council under Section 11.38.080 of this chapter.
D. 
Any vehicle which is identified by a disabled or handicapped driver meeting the requirements of Vehicle Code Section 22511.5 and displaying handicapped license plate.

A violation of this chapter shall be punishable as an infraction as provided in Section 1.12.020 of this code.
