The chief of the animal control division shall take up and impound in the animal control center, in a manner consistent with recognized standards of humane treatment, all animals found to be in violation of the provisions of this title or of Chapter 7 of Division 9 of the Food and Agricultural Code of the state.

Except as otherwise provided in this chapter, all animals impounded at the animal control center shall be kept and maintained at least for the following redemption periods:
A. 
Five days for any dog found wearing a current annual license tag;
B. 
Seventy-two hours for any dog found not wearing a current annual license tag;
C. 
Five days for any animal governed by the provisions of Section 17003 of the Food and Agriculture Code of the state; and
D. 
Seventy-two hours for any other animal.

A. 
The owners of impounded animals, during the redemption period and at any time before the disposition of such animals, may redeem them by paying the impoundment fees and licensing dogs in the manner provided in this section.
B. 
The chief of the animal control division shall charge and collect the following fees for every impounded animal when claimed and before release:
1. 
For food and ordinary care:
a. 
Dog/cat/small animal, three dollars per day,
b. 
Livestock/large animal, five dollars per day;
2. 
For extraordinary care or expenses, including livestock impoundment, actual costs incurred;
3. 
Redemption fees as follows:
a. 
For the first impoundment within any twelve-month period, fifteen dollars,
b. 
For the second impoundment within any twelve-month period, twenty dollars,
c. 
For the third and subsequent impoundments within any twelve-month period, thirty dollars,
d. 
For livestock impoundment, thirty dollars.
C. 
No dog four months or older may be redeemed unless a dog license is issued for it; however, if the dog has not been vaccinated against rabies or exempted therefrom by the submission of an exemption certificate issued in accordance with the provisions of this title, the dog may be released to an owner who has paid all the fees required, including the license fee, on the condition that such owner shall:
1. 
Have the dog vaccinated for rabies within two days; and
2. 
Exhibit a valid certificate of vaccination to the chief of the animal control division within two days, at which time the license will be issued.
D. 
A dog less than four months of age may be redeemed upon submission of a dog license application and payment of all applicable fees, including the license fee, on the condition that the owner shall have the dog vaccinated for rabies and present a valid certificate of vaccination within fifteen days of the dog reaching four months of age, at which time the license shall be issued.

Any animal which is voluntarily surrendered to or deposited with the animal control center, or authorized personnel thereof, shall not be deemed to be impounded and need not be kept or retained for any minimum period of time.

A. 
Except as otherwise prohibited by law, the chief of the animal control division may authorize the adoption of any animal in the care, custody and control of the animal control center which has been abandoned or voluntarily surrendered to or deposited with the animal control center or authorized personnel thereof. The chief of the animal control division may issue regulations to implement the provisions of this section. A fee of five dollars per animal shall be charged to defray costs associated with the adoption of the animal, which fee shall be in addition to all other fees provided for or authorized by law.
B. 
The chief of the animal control division may authorize the immunization of any dog, six months of age or less, which is voluntarily surrendered to or deposited with the animal control center or authorized personnel thereof by its legal owner, against certain viral diseases, including, but not necessarily limited to, immunization against canine distemper. A fee of two dollars and fifty cents shall be assessed to all persons adopting an immunized dog, which fee shall be in addition to all other fees provided for or authorized by law.

A. 
Except as otherwise provided in this title, an impounded animal which is not redeemed within the redemption period specified in this chapter, in the discretion of the chief of the animal control division, may be sold for not less than the amount of the redemption fees specified by this chapter, be destroyed, or be otherwise disposed of; provided, however, no animal shall be sold, destroyed or otherwise disposed of until seventy-two hours after a notice of the impoundment thereof has been given to the owner, if he or she is known.
B. 
If an animal is sold, the receipt, signed by the chief of the animal control division, shall be valid title to the animal.
C. 
Notwithstanding any other provision of this title to the contrary, an impounded animal which is determined by the chief of the animal control division to constitute a health hazard may be destroyed or otherwise disposed of as ordered by the chief of the animal control division, upon the concurrence of a veterinarian.
D. 
The possession of any animal governed by the provisions of Section 17003 of the Food and Agriculture Code of the state shall be delivered to the Director of the Department of Agriculture of the state or designee.

A. 
The chief of the animal control division may provide euthanasia services on animals whose owners request it. The chief of the animal control division may issue regulations to implement the provisions of this section.
B. 
A fee of five dollars shall be charged and collected by the animal control division for every animal which is euthanized at its owner's request. This fee shall be waived upon submission of proof that the owner of the animal is sixty-five years of age or older.
