The city council declares that any violation of the performance standards set forth in Chapter 18.20 of this title is, and shall be, a public nuisance, in that compliance with such performance standards by all development in areas subject to this title is necessary to prevent substantial harm to the environment occasioned by increase in base flood depths; and to prevent substantial harm to the owners and subsequent owners of the property occasioned by locating habitable floors lower than the base flood elevation; and to prevent substantial harm to other properties located downstream from the offending structure into a floodflow; and presents a threat of decertification of the city program by the Federal Insurance Administrator, with the corresponding unavailability of flood insurance, and therefore, federally subsidized purchase money loans for construction within the area which is subject to this title.

Any person who violates the terms of any permit issued pursuant to this chapter after the receipt of a final decision upon a notice of violation shall be guilty of conducting a public nuisance and shall be guilty of a violation of this chapter for each and every day such nuisance is maintained.

The penalty for violations of this chapter shall be a misdemeanor as set forth in Chapter 1.12 of this code.
