"Street improvements,"
within the meaning of this Chapter, shall mean: curb, gutter, sidewalk, fire hydrants, street lighting, water and sewer lines, drainage facilities, power lines and street and alley surfacing.
"Unsubdivided areas"
shall mean:
1. 
All portions of the City not lying in the area circumscribed by the perimeter boundary of "O" Street, Locust Avenue, "A" Street and College Avenue.
2. 
Excepting therefrom, however: All areas subdivided by a map under the Subdivision Map Act of the State, Statutes of 1943, Chapter 128 as amended, of record in office of county recorder.

No construction shall be commenced within the unsubdivided areas of the City except where the following standards and procedures are followed and a permit to commence construction is first obtained in accordance therewith. Nothing herein shall be deemed to give jurisdiction to this Chapter when a permit has been granted on a condition fixed by Chapter 12.28. The provisions of this Chapter shall not be construed or interpreted as (a) regulating building or construction or (b) relating to building permits and building inspection.

The applicant shall present to the Clerk his or her plans for the structure for which the permit is requested and his or her application for a permit hereunder. The plans shall show the relation of the proposed structure to the surrounding area, the existing street improvements and also which ones are planned to be installed by applicant with the structure for which the permit is requested. The clerk shall refer the application and plans to the Commission.

A. 
It is hereby found that the public health and safety require that the following minimum standards be met for any construction in the unsubdivided area:
1. 
That the proposed structure will not unduly interfere with the future orderly development of the general unsubdivided areas in which the structure is to be located;
2. 
That adequate and safe egress and ingress for the public to the new structure and its surrounding area be provided;
3. 
That necessary fire and police protection can be extended to and provided for the new structure in accordance with such protection given to rest of the City;
4. 
That sanitation and utility services for power, water and sewage are provided for the proposed structure;
5. 
That said structure will have adequate drainage and tie in with the drainage for the balance of the City.
B. 
It is hereby determined that unless all areas of the City on which buildings are constructed and inhabited provide proper access for the foregoing purposes, all such areas will suffer.
C. 
It is further found by the Council that the provisions of this Chapter shall not apply to the areas of the City which are not described in the definition of "unsubdivided areas" because either improvements to meet the requirements are already installed, or because other laws or provisions of this Code have already provided methods of providing said requirements.

The Planning Commission shall review the applicant's plan at its next regular meetings. The Commission shall determine the nature of the existing street improvements within the surrounding area, and the extent and nature of additional street improvements to serve the proposed structure. In addition, the Commission shall determine whether the plans are in conformity with the minimum standards. The Commission shall either grant, conditionally grant or deny the permit within 30 days of the initial review by the Commission unless said time period is extended by mutual consent of the. subdivider and the Commission. In the event it is granted upon condition that certain improvements are to be installed, the Commission shall set forth the nature and extend and estimated cost of said improvements. Failure to act within said 30-day period or agreed extension thereon, shall be deemed an unconditional grant of the permit. A written copy of any action taken by the Commission shall be mailed to the applicant immediately following the date of said action.

The applicant or any other person affected may appeal the action of the Planning Commission to the City Council by filing a notice of appeal in accordance with the requirements of Chapter 1.32 of this Code.

No construction shall be commenced nor shall any permit be issued therefore unless and until the applicant guarantees the construction of the required street improvements in the form and manner provided for in Chapter 12.28.
