The Rancho Mirage library and observatory board is hereby established
and shall serve as a legislative body responsible for establishing
policies for the operation of the library and observatory. The faithful
implementation of the policies adopted by the board shall be the responsibility
of city employees assigned to the library and observatory.

The board shall consist of the five members of the city council. The board members shall individually hold office for a term which coincides with their respective terms of office on the city council. Vacancies that may occur shall be filled in accordance with Section
2.02.130 of the municipal code.

The board shall meet at least once a month, at such times and
places as it may fix by resolution.

A majority of the members of the board shall constitute a quorum
for the transaction of business. The board shall act only by ordinance,
resolution, or motion, and a recorded vote of a majority of the quorum
of the board is required on each action. The board shall keep a record
of all action taken.

The board shall ensure that all monies acquired for the purposes
of the library or observatory by gift, devise, bequest or otherwise
shall be apportioned to a fund designated as the library and observatory
fund and shall be applied only to the purposes herein authorized.
Payments from the fund shall be made in the same manner as provided
for the payment of other demands against the city; provided that all
demands on such fund shall be first presented to the board and approved
by it, before being approved for payment and ordered paid by the city
council.

The board shall ensure that the library and observatory shall
be at no cost to residents of the Coachella Valley and visitors to
the city, subject to the rules and regulations of the board.

The board shall ensure that title to all property acquired for
the library and/or observatory shall be and remain in the name of
the city.

Any change in the name of the library and observatory shall
require a four-fifths vote of the board.

The board shall establish its own rules of proceedings and decorum.
