The purpose of this chapter is to promote and protect public safety and the general welfare of the community by providing the customers, clients, patrons, consumers, shoppers, purchasers, vendors, invitees, visitors, employees and other such guests of the merchants doing business within certain areas of the city, with time-restricted parking on city streets, safer ingress and egress to said businesses by providing preferential parking privileges for the benefit of such merchants.

For the purposes on this chapter, the following words and phrases shall have the following meanings.
"Guest"
shall mean any customer, client, patron, consumer, shopper, purchaser, vendor, invitee, visitor, or employee of a merchant.
"Merchant"
shall mean any person or entity which owns or leases a parcel of real property or any improvement located thereon that is used for commercial or office purposes, which is located along any public street identified in this chapter as being subject to time-restricted parking limitations.

All merchants, as defined in this chapter, conducting business along the time-restricted streets designated below shall be eligible for preferential parking permits issued by the city, pursuant to the provisions set forth in this chapter.

A. 
Any eligible merchant may apply to the city's development services director or designee for issuance of preferential parking permits, up to the number permitted per Section 10.49.020. The application shall include, at minimum: (1) the name and address of the applicant's business; (2) the city business license number for the applicant's business; (3) the number of permits requested; (4) the number of active permits held by the applicant as of the date of the application (if any); and (5) a description and number of any off-street parking spaces available to the applicant and its guests.
B. 
The city's development services director or designee may issue preferential parking permits to an eligible merchant, if the director determines that: (1) the information provided in the preferential parking permit application is true and correct; (2) the merchant possesses a validly issued city business license that is in good standing; (3) there are available preferential parking permits; and (4) the applicant has demonstrated a reasonable need for on-street parking for its guests and the number of preferential parking permits requested.
C. 
Preferential parking permits will be issued in the name of the applicant and shall be used only by the applicant and its guests visiting the merchant's business for business purposes at no cost to the guests.
D. 
Preferential parking permits shall be issued on an annual basis, subject to renewal. There shall be no fee for the initial issuance or renewal of preferential parking permits.
E. 
Preferential parking permits are nontransferable and shall not be bought, sold, exchanged, traded, rented or otherwise offered in exchange for any form of tangible or intangible monetary remuneration.

Preferential parking permits shall authorize the merchant and its guests to park a single vehicle each on or along the time-restricted street(s) for which the permit was issued, provided that the permit is displayed in a conspicuous location in the subject vehicle.

A. 
The city's development services director or designee shall be authorized to summarily suspend or revoke a preferential parking permit under any of the following circumstances:
1. 
The merchant's city business license becomes invalid for any reason;
2. 
The merchant's business is delinquent on the payment of any fees, assessments or taxes owed to the city;
3. 
The merchant's business has been closed for business for six consecutive months;
4. 
The permit is used in any manner inconsistent with any provision of the municipal code or in violation of any local, state or federal law or regulation; or
5. 
The permit has expired and has not been renewed.
B. 
The determination made by the city's development services director or designee to suspend or revoke a preferential parking permit shall be deemed final and conclusive and not appealable to the city council, a hearing officer or any other decision-making body of the city.
