It is the intent of this chapter to provide a consistent standard for the construction of driveway approaches and portions of driveways within the public right-of-way. This will result in driveway improvements that are structurally sound, able to contain drainage, safe for use by the public, and aesthetically pleasing.

A city encroachment permit shall be obtained from the department of public works prior to construction of a driveway approach that encroaches upon the public right-of-way.

A. 
All persons constructing a driveway approach within the public right-of-way and/or portions of a driveway within the public right-of-way shall be required to execute a covenant, prepared by the City Attorney, that runs with the land which provides for a right of ingress and egress, a waiver of damages, and indemnifies the city.
B. 
If an alternative material is used to construct the driveway approach, other than broom finished gray Portland cement concrete, the covenant shall require the Homeowner to maintain, repair, replace, or reconstruct any portion of the driveway approach or the driveway which is damaged or destroyed as a result of any activity within the public right-of-way performed by the city, its agents, employees, or contractors, including utility companies.
C. 
This covenant shall be executed and delivered to the City Engineer prior to an encroachment permit being issued for the construction of the improvements.

All driveway approaches shall be constructed in the location shown on the approved grading plan or site drainage plan. Any approach deviating from that location shown on the approved plan shall be subject to immediate removal and shall be replaced in the approved location at the sole expense of the owner.

A. 
The standards for construction of all driveway approaches shall be those established by the Rancho Mirage Manual of Improvement Standards, a copy of which shall be maintained by the City Engineer.
B. 
The use of alternative paving surfaces and materials such as brick, stone, concrete pavers, stamped concrete, exposed aggregated concrete, etc. on the driveway approach and the portion of the driveway within the public right-of-way shall be permitted provided that the installation of such alternative paving surfaces and materials conform with the applicable standards of construction promulgated by the City Engineer as a part of the Rancho Mirage Manual of Improvements Standards referenced hereinabove and the required covenant is provided as set forth in section 15.68.030 above. In addition, the owner shall provide evidence that the use of such alternative paving surfaces and materials are not otherwise prohibited by any applicable private conditions, covenants or restrictions.
